Pursuant to an announcement from the house floor on May 28, 2023, and permission granted on May 1, 2023, to meet while the House was in session for the remainder of session, the House Committee on General Investigating met in a formal meeting and was called to order by the chair, Representative Murr, at 7:03 p.m.

 

The initial quorum call was answered as follows: Representatives Murr; Johnson, Ann; Geren; and Spiller.

 

A quorum was present.

 


 

 

 

 

Without objection, the committee entered into executive session under Subchapter B, Chapter 301, Government Code, the Rules of Procedure of the House of Representatives, the Housekeeping Resolution, and the committee’s rules.

 

The committee exited the executive session. No decisions were made or voted on during the executive session.

 

Representative Geren offered the following in writing:

 

Mr. Chairman:

Pursuant to Rule 4, Section 21(a), of the House Rules of Procedure, and Section 301.024(a), Government Code, I move as follows:

(1)  The issuance of subpoenas is authorized in the Matter of Warren Kenneth Paxton, Jr., as follows:

(A)  Uber Technologies, Inc., to provide all relevant testimony and information concerning the committee's inquiry; and

(B)  Charles Loper, to provide all relevant testimony and information concerning the committee's inquiry; and

(C)       Ester Blind Trust, to provide all relevant testimony and information concerning the committee's inquiry; and

(D)       F&M Bank & Trust, to provide all relevant testimony and information concerning the committee's inquiry; and

(E)       Madison G. Dean Trust, to provide all relevant testimony and information concerning the committee's inquiry; and

(F)       Bank of the Ozarks, to provide all relevant testimony and information concerning the committee's inquiry; and

(G)       Alliance Bank of Central Texas, to provide all relevant testimony and information concerning the committee's inquiry; and

(H)       Marquis at Treetops, to provide all relevant testimony and information concerning the committee's inquiry; and

(I)        Marquis on Gaston, to provide all relevant testimony and information concerning the committee's inquiry; and

(J)        First Financial Bank, to provide all relevant testimony and information concerning the committee's inquiry; and

(K)       Benchmark Mortgage, to provide all relevant testimony and information concerning the committee's inquiry; and

(L)       Mindy Montford, to provide all relevant testimony and information concerning the committee's inquiry. 

(2)  The committee chair is directed to issue the process authorized by this motion in a form acceptable to the chair.  The committee chair may issue one or more subpoenas for a part or portion of any relevant testimony or information as necessary to avoid overburdening a witness or the committee.

 

 

 

 

(3)  The committee chair is authorized to appoint, on the committee's behalf, a sergeant-

at-arms or an agent to serve the authorized process.

 

The motion prevailed by the following record vote:

 

Ayes:                           Representatives Murr; Johnson, Ann; Geren; Spiller (4).

 

Nays:                           None (0).

 

Present, Not Voting:   None (0).

 

Absent:                        Representative Longoria (1).

 

At 7:18 p.m., on the motion of the chair and without objection, the meeting was adjourned subject to the call of the chair.
