Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Redistricting, Select was held on Friday, June 3, 2011, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 9:16 AM. There being a quorum present, the following business was transacted:

 

The chair gave opening remarks.

 

Senator Gallegos assumed the chair.

 

The chair laid out SB 4 and recognized the author, Senator Seliger, to explain the bill.

 

Senator Seliger resumed the chair.

 

Senator Watson and Senator Rodriguez made remarks on SB 4.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

Senator Zaffirini assumed the chair.

 

Senator Seliger resumed the chair.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

At 3:53 PM Senator Seliger moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.

 

At 7:05 PM the Committee reconvened.

 

Senator Gallegos laid out Demonstration 1.

Senator Gallegos, Jr. sent up a proposed committee substitute; the chair recognized Senator Gallegos, Jr. to explain the difference between the proposed committee substitute and the senate bill as filed. Senator Gallegos, Jr. moved adoption of the proposed committee substitute; there was objection. The motion failed with a record vote of 6 ayes, 8 nays, 0 present not voting, and 1 absent. 

 

Senator Gallegos assumed the chair.

 

Senator Seliger sent up a proposed committee substitute; the chair recognized Senator Seliger to explain the difference between the proposed committee substitute and the senate bill as filed.

 

Senator Williams sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.

 

Senator Uresti sent up Committee Amendment 2 and moved adoption; The motion failed with a record vote of 4 ayes, 8 nays, 0 present not voting, and 3 absent. 

 

Senator Seliger requested unanimous consent to incorporate Committee Amendment 1 into the proposed committee substitute; without objection, it was so ordered. Senator Seliger then moved that the new committee substitute be adopted; there was objection. The motion carried with a record vote of 9 ayes, 3 nays, 0 present not voting, and 3 absent.

 

 Senator Seliger moved that SB 4 do not pass but that CSSB 4 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 6 nays, 0 present not voting, and 0 absent.

 

Senator Seliger resumed the chair.

 

Senator Carona submitted a motion in writing and asked to be shown voting aye on SB4. Without objection, it was so ordered.

 

Senator West submitted a motion in writing and asked to be shown voting nay on SB 4. Without objection, it was so ordered.

 

Senator Hinojosa submitted a motion in writing and asked to be shown voting nay on SB 4. Without objection, it was so ordered.

 

There being no further business, at 7:30 PM Senator Seliger moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
