Amend the amendment identified as Chief Clerk's #821506 found at page 78 of prefiled amendments to CSSB 1420 (house committee report), as follows:

In an appropriately numbered section of the bill, insert the following subparagraphs (to be properly enumerated):

(____) A person may not act as general, outside, or retained counsel to the department if the person is required to register as a lobbyist under Chapter 305, Government Code, because of the person's activities for compensation on behalf of a profession related to the operation of the department. A person who acts as general counsel to the department must be licensed as an attorney in this state.

(____) The changes in law made by this Act to Section 201.401, Transportation Code, in the qualifications of the general counsel of the Texas Department of Transportation do not affect the entitlement of a person serving in that position immediately before the effective date of this Act to continue to carry out the position's functions for the remainder of the position's term. The changes in law apply only to a general counsel appointed on or after the effective date of this Act. This Act does not prohibit a person who is serving as the general counsel on the effective date of this Act from being reappointed to that position if the person has the qualifications required for the position under Section 201.401, Transportation Code, as amended by this Act.
