Pursuant to suspension of Senate Rules 11.10 and 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Wednesday, May 6, 2009, at Senator Whitmire's Desk on the Senate Floor in Austin, Texas.

The chair called the meeting to order at 1:40 p.m. There being a quorum present, the following business was transacted:
As a matter of pending business, the chair laid out SB 1709. Senator Hinojosa moved adoption of the committee substitute that was explained during the public hearing on April 28, 2009; without objection, it was so ordered. Senator Hinojosa moved that SB 1709 do not pass but that CSSB 1709 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.
As a matter of pending business, the chair laid out HB 4314 in lieu of SB 426. Senator Hinojosa moved that HB 4314 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent. Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
There being no further business, at 1:42 p.m. Senator Whitmire moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
