Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Natural Resources was held on Friday, April 17, 2009, at Senator Averitt's Desk.

On Thursday, April 16, Senator Averitt announced from the Senate floor, that the committee would continue the April 16 hearing at his desk on Friday, April 17, 2009, upon adjournment of the Senate.

 

The chair called the meeting to order at 2:50 p.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out as a matter of pending business SB 213.

 

Senator Hinojosa moved that SB 213 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 3 absent. 

 

Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out HB 2073 in lieu of the pending senate companion bill, SB 673. 

 

Senator Hegar moved that HB 2073 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 3 absent. 

 

Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 1595 in lieu of the pending senate companion bill, SB 1262.

 

Senator Uresti moved that HB 1595 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 3 nays, 0 present not voting, and 2 absent. 

 

The chair laid out HB 2457 in lieu of the pending senate companion bill, SB 1293.

 

Senator Estes moved that HB 2457 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Estes moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 1405.

 

Senator Hinojosa moved that SB 1405 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 2 nays, 0 present not voting, and 2 absent. 

 

The chair laid out as a matter of pending business SB 2049.

 

Senator Averitt moved adoption of the committee substitute laid out at a previous hearing; without objection, it was so ordered. 

 

Senator Averitt sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

 

Senator Averitt requested unanimous consent to incorporate amendments into the committee substitute; without objection, it was so ordered.  Senator Averitt then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Averitt moved that SB 2049 do not pass but that CSSB 2049 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Averitt moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 2120.

 

Senator Seliger sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the senate bill as filed.  Senator Seliger moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Seliger sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

 

Senator Seliger requested unanimous consent to incorporate amendments into the committee substitute; without objection, it was so ordered.  Senator Seliger then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Seliger moved that SB 2120 do not pass but that CSSB 2120 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 2 absent.

Senator Estes moved adoption of the committee substitute laid out at a previous hearing; without objection, it was so ordered.

Senator Averitt moved that SB 1406 do not pass but that CSSB 1406 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 1 nay, 1 present not voting, and 2 absent.

Senator Estes moved that SB 2126 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 2 absent.
