Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, April 10, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:34 a.m.  There being a quorum present, the following business was transacted:

 

The chair laid out SB 1679 and recognized the author, Senator Janek, to explain the bill.  Senator Janek sent up a committee substitute; the chair recognized Senator Janek to explain the difference between the committee substitute and the senate bill as filed.   Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 1679 pending to await a quorum.

 

The chair laid out SB 603 and recognized the author, Senator Van de Putte, to explain the bill. Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed.  

 

At 9:02 a.m. Senator Janek assumed the chair. 

 

Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 603 pending to await a quorum.

 

The chair laid out SB 1713 and recognized the author, Senator Eltife, to explain the bill.  Senator Van de Putte sent up a committee substitute; the chair recognized Senator Eltife to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 1713 pending to await a quorum.

 

The chair laid out SB 1871 and recognized Senator Van de Putte, in the absence of the author, to explain the bill.  Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 1871 pending.

 

At 9:31 a.m. Senator Shapiro resumed the chair.

Senator Janek moved adoption of the minutes from the previous hearings held on April 3, 2007, and March 29, 2007; without objection, it was so ordered. 

 

As a matter of pending business the chair laid out SB 603 by Senator Van de Putte.  Senator Patrick sent up Committee Amendment 1.  Senator Patrick withdrew Committee Amendment 1.  Senator Patrick sent up Committee Amendment 2 and moved adoption; without objection, the amendment was adopted.  Senator Van de Putte was recognized on a motion to incorporate amendments into the committee substitute; without objection, it was so ordered.  Senator Van de Putte was recognized on a motion that the new committee substitute be adopted; without objection, it was so ordered.  Senator Van de Putte moved that SB 603 do not pass but that CSSB 603 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business the chair laid out SB 1679 by Senator Janek.  Senator Janek moved adoption of the committee substitute; without objection, it was so ordered.  Senator Janek moved that SB 1679 do not pass but that CSSB 1679 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business the chair laid out SB 1713 by Senator Eltife.  Senator Janek moved adoption of the committee substitute; without objection, it was so ordered.  Senator Janek moved that SB 1713 do not pass but that CSSB 1713 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business the chair laid out SB 1871 by Senator Zaffirini.  Senator Van de Putte moved adoption of the committee substitute; without objection, it was so ordered.  Senator Janek moved that SB 1871 do not pass but that CSSB 1871 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out the subcommittee report on SB 649 by Senator Shapleigh.  Senator Williams then moved adoption of the subcommittee report; there being no objection, it was so ordered.   Senator Williams moved that SB 649 do not pass but that CSSB 649 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Williams moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out the subcommittee report on SB 1046 by Senator Wentworth.  Senator Williams then moved adoption of the subcommittee report; there being no objection, it was so ordered.   Senator Williams moved that SB 1046 do not pass but that CSSB 1046 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Williams moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out the subcommittee report on SB 1052 by Senator Zaffirini.  The chair left SB 1052 pending.

 

The chair laid out the subcommittee report on SB 1232 by Senator Zaffirini.  Senator Janek then moved adoption of the subcommittee report; there being no objection, it was so ordered.   Senator Janek moved that SB 1232 do not pass but that CSSB 1232 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.  Senator Zaffirini moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out the subcommittee report on SB 1418 by Senator Hinojosa.  Senator Van de Putte then moved adoption of the subcommittee report; there being no objection, it was so ordered.   Senator Van de Putte moved that SB 1418 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent. 

 

At 9:54 a.m. Senator Shapiro moved that the committee stand recessed subject to the call of the chair; without objection, it was so ordered. 

 

Subject to the suspension of Senate Rule 11.10(a) at 11:59 am the committee reconvened at Senator Shapiro’s desk.

Senator Van de Putte moved that SB 1418 be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator West requested unanimous consent to be showing voting aye on CSSB 1679, CSSB 603, CSSB 1713, CSSB 1871, CSSB 649, CSSB 1046, SB 1052, CSSB 1232, SB 1418.

 

There being no further business, at 12:01 p.m. Senator Shapiro moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
