BACKGROUND AND PURPOSE

 

Currently the governor may adopt a flag for ceremonial purposes.  However recent governors have chosen not to adopt a flag.  This bill would designate one specific official flag for the office of the governor.  This will give consistency and build recognition for the flag of the governor's office.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill amends Section 401.104 of the Government Code to stipulate that the governor's flag is the 1839 pilot flag of the Republic of Texas.

 

The bill stipulates the composition and description of the flag, including colors, design and arrangement.

 

The bill stipulates the proper display specifications.

 

The bill stipulates that the governor may prescribe any changes relating to the description or display of the flag that the governor considers appropriate.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
