         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Natural  
         Resources was held on Tuesday, February 1, 2005, in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 1:10 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Estes moved adoption of Committee rules.  There being no  
         objection the motion prevailed.   
          
         The Chair recognized the following witnesses for testimony on  
         the status of material in the TDS Landfill resulting from an  
         October 9, 1997, trucking accident involving Zenith electronic  
         components:  
          
         Rafael Marquez, Commissioner, Texas Commission on Environmental

         The Chair recognized the following witnesses for testimony on  
         the status of possible transportation of radioactive material  
         currently stored in the three silos at Fernald in Ohio to a  
         disposal facility in Andrews, Texas:

         There being no further business, at 6:38 PM, Senator Armbrister  
         moved that the Committee stand recessed subject to the call of
