Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on State Affairs
was held on Thursday, April 21, 2005, in the Senate Chamber at
Austin, Texas.

The chair called the meeting to order at 1:37 p.m. There being
a quorum present, the following business was transacted:
Senator Madla assumed the chair.
The chair laid out SB 1284 and recognized the author, Senator
Armbrister, to explain the bill. Senator Armbrister moved that
SB 1284 be left pending to await a quorum; without objection, it
was so ordered. Upon arrival of a quorum, Senator Armbrister
moved that SB 1284 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 8 ayes, 0 nay, 0 present not
voting, and 1 absent. Senator Ellis moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
Senator Armbrister assumed the chair.
The chair laid out SB 520 and recognized the author, Senator
Madla, to explain the bill. Senator Madla sent up a committee
substitute; the chair recognized Senator Madla to explain the
difference between the committee substitute and the bill as
filed. Senator Madla moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Madla moved that
SB 520 be left pending to await a quorum; without objection, it
was so ordered. Upon arrival of a quorum, Senator Madla moved
that SB 520 do not pass but that CSSB 520 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 8 ayes, 0
nay, 0 present not voting, and 1 absent. Senator Madla moved
that the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.

reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 8

moved that the committee substitute for SB 698, which he offered
at a previous hearing be adopted; without objection, it was so
ordered. Senator Armbrister moved that SB 698 do not pass but
that CSSB 698 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 8 ayes, 0 nay, 0 present not
voting, and 1 absent. Senator Armbrister moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The chair laid out pending business SB 1648. Senator Fraser
sent up Committee Amendment 1 and moved adoption; without
objection, the amendment was adopted. The bill was left pending
before the committee.
Senator Williams assumed the chair.
The chair laid out pending business SB 121. Senator Armbrister
moved to reconsider the vote by which a previous committee
substitute had been adopted; without objection, it was so
ordered. Senator Duncan sent up a new committee substitute; the
chair recognized Senator Duncan to explain the difference
between the committee substitute and the bill as filed. Senator
Duncan moved to reopen public testimony; without objection, it
was so ordered. Witnesses testifying and registering on the
bill are shown on the attached list. The chair moved that the
public testimony be closed; without objection, it was so
ordered. The bill was left pending before the committee.

There being no further business, Senator Duncan moved that the
