Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on State Affairs
was held on Tuesday, February 28, 2006, in the Senate Chamber at
Austin, Texas.

The chair called the meeting to order at 2:54 p.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 88 and recognized the author, Senator
Averitt, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Duncan moved that SB 88
be left pending to await a quorum; without objection, it was so
ordered. Upon arrival of a quorum, Senator Lucio, Jr. moved
that SB 88 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 0 absent. Senator Harris moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The chair laid out SB 148 and recognized the author, Senator
Wentworth, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Duncan moved that SB 148
be left pending to await a quorum; without objection, it was so
ordered. Upon arrival of a quorum, Senator Lucio, Jr. moved
that SB 148 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 0 absent. Senator Harris moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The chair laid out SB 450 and recognized the author, Senator
Wentworth, to explain the bill. Senator Madla sent up Committee
Amendment 1 and Committee Amendment 2. These amendments were
left pending awaiting the arrival of a quorum. Senator Duncan
moved that SB 450 be left pending to await a quorum; without
objection, it was so ordered. Upon arrival of a quorum, Senator
Madla moved adoption of Committee Amendments 1 and 2; without
objection, the amendments were adopted. Senator Williams moved
that SB 450, as amended, be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 0 absent.
The chair laid out SB 261 and recognized Senator Madla, in the
absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;

before the committee.

absence of the author, to explain the bill. The chair moved

Barrientos, to explain the bill. The chair moved that the

ordered. Senator Duncan moved that SB 182 be left pending to
await a quorum; without objection, it was so ordered. Upon
arrival of a quorum, Senator Williams moved that SB 182 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 9 ayes, 0 nay, 0 present not voting, and 0 absent. Senator
Harris moved that the bill be recommended for placement on the
Local & Uncontested Calendar; without objection, it was so
ordered.
The chair laid out SB 211 and recognized Senator Madla, in the
absence of the author, to explain the bill. The chair moved
that the public testimony be closed; without objection, it was
so ordered. SB 211 was left pending business before the
Committee.
The chair laid out SJR 10 and recognized Senator Madla, in the
absence of the author, to explain the bill. Senator Madla sent
up a committee substitute; the chair recognized Senator Madla to
explain the difference between the committee substitute and the
bill as filed. The committee substitute was left on the table.
The chair moved that the public testimony be closed; without
objection, it was so ordered. SJR 10 and its proposed committee
substitute were left pending business before the Committee.
The chair laid out pending business SB 5 and recognized the
author, Senator Staples, to explain the bill. Senator Madla
sent up a committee substitute; the chair recognized Senator
Staples to explain the difference between the committee
substitute and the bill as filed. The committee substitute was
left on the table awaiting the arrival of a quorum. Upon the
arrival of a quorum, Senator Madla moved adoption of the
committee substitute; without objection, it was so ordered.
