Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Finance was
held on Friday, May 12, 2006, in the Capitol Extension, Room
E1.036, at Austin, Texas.

The chair called the meeting to order at 5:30 p.m. There being
a quorum present, the following business was transacted:
The posting rule, Senate Rule 11.18, was suspended to hear the
following bill(s): SB 2, HB 63, HB 72, HB 154, and HJR 26.
The chair laid out HB 154 and recognized the Senate sponsor,
Senator Lucio, Jr., to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Madla moved that HB 154
be reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.
The chair laid out HJR 26 and recognized the Senate sponsor,
Senator Deuell, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Ogden moved that HJR 26
be left pending; without objection, it was so ordered.
The chair laid out HB 72 and recognized the Senate sponsor,
Senator Deuell, to explain the bill. Senator Ogden moved that
HB 72 be left pending; without objection, it was so ordered.
The chair laid out SJR 9 and recognized the author, Senator
Barrientos, to explain the bill. Senator Hinojosa sent up a
committee substitute; the chair recognized Senator Hinojosa to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Ogden moved that SJR 9 be left pending; without
objection, it was so ordered.
The chair laid out SB 17 and recognized the author, Senator
Barrientos, to explain the bill. Senator Ogden moved that SB 17
be left pending; without objection, it was so ordered.
The chair laid out HB 63 and recognized the Senate sponsor,
Senator Williams, to explain the bill. Senator Williams sent up
a committee substitute; the chair recognized Senator Williams to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Williams moved that HB 63 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 14 ayes, 0 nay, 0
present not voting, and 1 absent.
The chair laid out HB 149 in lieu of companion bill SB 2, and
recognized the Senate sponsor, Senator Averitt, to explain the
bill. Witnesses testifying and registering on the bill are
shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Ogden moved that HB 149 be left pending; without
objection, it was so ordered.
There was no action taken for the following bill(s): SB 2, SB
6, SB 13, SB 15, SB 16, and SB 37.
There being no further business, at 6:44 p.m. Senator Ogden
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
