Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Finance was
held on Thursday, July 7, 2005, in the Capitol Extension, Room
E1.036, at Austin, Texas.

The chair called the meeting to order at 4:35 p.m. There being
a quorum present, the following business was transacted:
Senator Zaffirini assumed the chair.
The chair laid out SB 6, which had been left pending at a
previous hearing. Witnesses testifying and registering on the
bill are shown on the attached list. The chair moved that the
public testimony be closed; without objection, it was so
ordered. Senator West sent up Committee Amendment 11 and then
withdrew the amendment; without objection, it was so ordered.
Senator Shapiro sent up Committee Amendment 12 and then
temporarily withdrew the amendment; without objection, it was so
ordered. Senator Barrientos sent up Committee Amendment 13 and
moved adoption; without objection, the amendment was adopted.
Senator Duncan sent up Committee Amendment 14 and then
temporarily withdrew the amendment; without objection, it was so
ordered. Senator Shapiro sent up Committee Amendment 12, which
had been temporarily left pending, and moved adoption; without
objection, the amendment was adopted. Senator Duncan sent up
Committee Amendment 14, which had been temporarily left pending,
and moved adoption; without objection, the amendment was
adopted. Senator Ogden requested unanimous consent to roll the
amendments into a committee substitute; without objection, it
was so ordered. Senator Ogden then moved that the committee
substitute be adopted; without objection, it was so ordered.
Senator Ogden moved that SB 6 do not pass but that CSSB 6 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of
14 ayes, 0 nay, 0 present not voting, and 1 absent.
Senator Ogden resumed the chair.
At 5:05 p.m. Senator Ogden moved that the Committee stand
recessed until the adjournment of the Senate; without objection,
it was so ordered.
The Committee reconvened at 7:07 p.m.
Senator Zaffirini assumed the chair.
The chair laid out HB 3 and recognized the Senate sponsor,
Senator Ogden, to explain the bill. Senator Ogden sent up a
committee substitute; the chair recognized Senator Ogden to
explain the difference between the committee substitute and the
bill as filed.
Senator Ogden moved to suspend Committee Rule #11 regarding Bill
Analyses; without objection; it was so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
Senator Zaffirini moved for a technical correction that all
amendments previously drafted and submitted for SB 3 be changed
to amendments for HB 3; without objection, it was so ordered.
Senator Ogden sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted. Senator
Barrientos sent up Committee Amendments 2-4, and then withdrew
the amendments; without objection, it was so ordered. Senator
Shapleigh sent up Committee Amendment 5, and then withdrew the
amendment; without objection, it was so ordered. Senator
Shapleigh sent up Committee Amendment 6, and then withdrew the
amendment; without objection, it was so ordered. Senator
Zaffirini sent up Committee Amendment 7, and then withdrew the
amendment; without objection, it was so ordered.
Senator Zaffirini sent up Committee Amendment 8, and then
withdrew the amendment; without objection, it was so ordered.
Senator Nelson sent up Committee Amendment 9, and then withdrew
the amendment; without objection, it was so ordered. Senator
Zaffirini sent up Committee Amendment 10, and then withdrew the
amendment; without objection, it was so ordered. Senator
Shapleigh sent up Committee Amendment 11, and then withdrew the
amendment; without objection, it was so ordered. Senator Nelson
sent up Committee Amendments 12 and 13, and then withdrew the
amendments; without objection, it was so ordered. Senator
Shapleigh sent up Committee Amendment 14, and then withdrew the
amendment; without objection, it was so ordered. Senator
Barrientos sent up Committee Amendment 15, and then withdrew the
amendment; without objection, it was so ordered. Senator Ogden
requested unanimous consent to incorporate amendments into the
committee substitute; without objection, it was so ordered.
Senator Ogden then moved that the new committee substitute be
adopted; without objection, it was so ordered. Senator Ogden
moved that HB 3 do not pass but that CSHB 3 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 9 ayes, 5
nays, 0 present not voting, and 1 absent. Senator Shapiro
requested unanimous consent to be shown voting aye; without
objection, it was so ordered.
Senator Ogden resumed the chair.
There being no further business, Senator Ogden moved that the
Committee stand recessed subject to the call of the chair.
