Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Finance was
held on Thursday, May 19, 2005, in the Capitol Extension, Room
E1.036, at Austin, Texas.

The chair called the meeting to order at 5:34 p.m. The
following business was transacted:
The chair laid out HB 1006 and recognized the Senate sponsor,
Senator Janek, to explain the bill. Senator Janek sent up a
committee substitute; the chair recognized Senator Janek to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Ogden moved that HB 1006 be left pending to await a
quorum; without objection, it was so ordered.
The chair laid out HB 573 and recognized Senator Averitt, in the
absence of the Senate sponsor, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Ogden moved that
HB 573 be left pending to await a quorum; without objection, it
was so ordered.
The chair laid out HB 809 and recognized Senator Shapleigh, in
the absence of the Senate sponsor, to explain the bill. Senator
Shapleigh sent up a committee substitute; the chair recognized
Senator Shapleigh to explain the difference between the
committee substitute and the bill as filed. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Ogden moved that
HB 809 be left pending to await a quorum; without objection, it
was so ordered.

the absence of the Senate sponsor, to explain the bill.

At 6:05 p.m. Senator Ogden moved that the Committee stand
recessed for 10 minutes; without objection, it was so ordered.
The Committee reconvened at 6:17 p.m.
Senator Zaffirini assumed the chair.
The chair laid out HB 10 and recognized the Senate sponsor,
Senator Ogden, to explain the bill. Senator Ogden sent up a
committee substitute; the chair recognized Senator Ogden to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill

previous hearing. Senator Duncan sent up a committee
substitute; the chair recognized Senator Duncan to explain the
difference between the committee substitute and the bill as
filed. Senator Ogden moved that HB 3001 be left pending;
without objection, it was so ordered.

The chair laid out HB 10, which had been left pending earlier in
the hearing. Senator Ogden moved adoption of a committee
substitute sent up earlier in the hearing; without objection, it
was so ordered. Senator Ogden moved that HB 10 do not pass but
that CSHB 10 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 10 ayes, 1 nay, 0 present not
voting, and 4 absent. Senator Janek and Senator West requested
unanimous consent to be shown voting aye; without objection, it
was so ordered.
Senator Ogden resumed the chair.
The chair laid out HB 573, which had been left pending earlier
in the hearing. Senator Duncan moved that HB 573 be reported
favorably to the Senate with the recommendation that it do pass
and be printed. The motion carried with a record vote of 11
ayes, 0 nay, 0 present not voting, and 4 absent. Senator West
requested unanimous consent to be shown voting aye; without
objection, it was so ordered. Senator Duncan moved that the
bill be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
The chair laid out HB 809, which had been left pending earlier
in the hearing. Senator Ogden moved adoption of a committee
substitute sent up earlier in the hearing; without objection, it
was so ordered. Senator Ogden moved that HB 809 do not pass but
that CSHB 809 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 11 ayes, 0 nay, 0 present not
voting, and 4 absent. Senator Ogden moved that the bill be

reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 11 ayes, 0 nay, 0 present not voting, and 4 absent.
The chair laid out the adopted committee substitute for HB 1006,
which had temporarily been left pending. Senator Janek moved
that HB 1006 do not pass but that CSHB 1006 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 10 ayes, 0
nay, 0 present not voting, and 5 absent.
There being no further business, at 7:21 p.m. Senator Ogden
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
