Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Finance was
held on Monday, April 18, 2005, in the Capitol Extension, Room
E1.036, at Austin, Texas.

The chair called the meeting to order at 9:02 a.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 1646 relating to the management of public
school land and the permanent school fund, and recognized the
author, Senator Staples, to explain the bill. Senator Staples
sent up a committee substitute; the chair recognized Senator
Staples to explain the difference between the committee
substitute and the bill as filed. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Ogden moved that SB 1646
be left pending; without objection, it was so ordered.
The chair laid out SB 1655 relating to settlement and discovery
in property tax appeals, and recognized the author, Senator
Staples, to explain the bill. Senator Staples sent up a
committee substitute; the chair recognized Senator Staples to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Ogden moved that SB 1655 be left pending until a time
certain vote; without objection, it was so ordered.
The chair laid out SB 567 relating to requiring a taxing unit to
include in the public notice notice of
a hearing on the adoption of an ad valorem tax
rate certain information relating to the taxing unit's budget

certain information relating to the taxing unit's budget and
appraisal roll, and recognized the author, Senator Deuell, to
explain the bill. Witnesses testifying and registering on the
bill are shown on the attached list. The chair moved that the
public testimony be closed; without objection, it was so
ordered. Senator Ogden moved that SB 567 be left pending until

The chair laid out SB 1501 relating to the imposition of a fee
for a currency transmission sent to a destination outside the
United States, and recognized the author, Senator West, to
explain the bill. Senator West sent up a committee substitute;
the chair recognized Senator West to explain the difference
between the committee substitute and the bill as filed.

the attached list.

Senator Deuell moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
The chair laid out SB 1538 relating to the creation of the
individual development account
account program to provide savings incentives and

The chair laid out SB 18 relating to the adoption of an ad
valorem tax rate by a taxing unit other than a school district,
which had been left pending at a previous hearing. Senator
Williams moved to withdraw a committee substitute sent up at a
previous hearing; without objection, it was so ordered. Senator
Williams sent up a new committee substitute; the chair
recognized Senator Williams to explain the difference between
the committee substitute and the bill as filed. Senator
Williams moved adoption of the committee substitute; without
objection, it was so ordered. Senator Williams moved that SB 18
do not pass but that CSSB 18 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 4 nays, 0 present not
voting, and 2 absent. Senator Brimer and Senator Shapiro
requested unanimous consent to be shown voting nay; without
objection, it was so ordered.
The chair laid out SB 1538 which had been left pending earlier
in the hearing. Senator Barrientos moved adoption of the
committee substitute sent up earlier in the hearing; without
objection, it was so ordered. Senator Barrientos moved that SB
1538 do not pass but that CSSB 1538 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 13 ayes, 0 nay, 0
present not voting, and 2 absent. Senator Zaffirini and Senator
Brimer requested unanimous consent to be shown voting aye;
without objection, it was so ordered.

Williams moved that SB 1569 be reported favorably to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a record vote of 13 ayes, 0 nay, 0 present
not voting, and 2 absent. Senator Zaffirini and Senator Brimer
requested unanimous consent to be shown voting aye; without
objection, it was so ordered. Senator Williams moved that the
bill be recommended for placement on the Local & Uncontested

Testimony on SB 1501 resumed. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Ogden moved that SB 1501 be left pending; without
objection, it was so ordered.
The chair laid out HB 1489 relating to the purposes for which
money in the compensation to victims of crime fund may be used,
and recognized the Senate sponsor, Senator Williams, to explain
the bill.
At 12:23 p.m. Senator Barrientos assumed the chair.

Senator Ogden moved that HB 1489 be left pending; without
objection, it was so ordered.

of public school funds, and recognized Senator Williams, in the
absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Ogden moved that
SB 1693 be left pending; without objection, it was so ordered.
No action was taken on the following bill: SB 1617 by Senator
Ogden.
There being no further business, at 12:31 p.m. Senator Ogden
moved that the Committee stand recessed subject to the call of
