Pursuant to suspension of Senate Rule 11.18, a public hearing of
the Standing Senate Subcommittee on Higher Education was held on
Tuesday, April 26, 2005, in the Senate Chamber at Austin, Texas.

The posting rule, Senate Rule 11.18, was suspended to hear the
following bill(s): SB 1208, SB 1701, SB 1844.
The chair called the meeting to order at 12:58 p.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 1208. Senator Zaffirini moved that SB
1208 be reported favorably to the Full Committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 2 absent.
The chair laid out SB 1701. Senator Averitt moved to pull down
the committee substitute and Committee Amendment 1 sent up on
April 11, 2005; without objection, it was so ordered. Senator
Averitt sent up a new committee substitute; the chair recognized
Senator Averitt to explain the difference between the committee
substitute and the bill as filed. Senator Averitt moved
adoption of the committee substitute; without objection, it was
so ordered. Senator Staples moved that SB 1701 do not pass but
that CSSB 1701 be reported back to the Full Committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 2 absent.
The chair laid out SB 1844. Senator Averitt moved adoption of
the committee substitute sent up on April 25, 2005; without
objection, it was so ordered. Senator Averitt moved that SB
1844 do not pass but that CSSB 1844 be reported back to the Full
Committee with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 2 absent.
Senator Averitt moved adoption of the minutes from the previous
hearings held on April 18, 2005, and April 19, 2005; without
objection, it was so ordered.
There being no further business, at 1:02 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
