the Standing Senate Subcommittee on Higher Education was held on
Tuesday, April 19, 2005, in the Senate Chamber at Austin, Texas.

The posting rule, Senate Rule 11.18, was suspended to hear the
following bill(s): SB 31, SB 532, SB 817, SB 927, SB 1037, SB
1208, SB 1227, SB 1300, SB 1528, SB 1544, SB 1553, SB 1594, SB
1671, SCR 17, SCR 27.
There was no action taken for the following bill(s): SB 817, SB
1208, SB 1594.
The chair called the meeting to order at 1:27 p.m. There being
a quorum present, the following business was transacted:
Senator Janek moved adoption of the minutes from the previous
hearings held on April 4, 2005, April 5, 2005, April 11, 2005,
and April 12, 2005; without objection, it was so ordered.
The chair laid out SB 31 and recognized the author, Senator
Zaffirini, to explain the bill. Senator Zaffirini moved to pull
down the committee substitute and Committee Amendment 1 sent up
on April 18, 2005. Senator Zaffirini sent up a new committee
substitute; the chair recognized Senator Zaffirini to explain
the difference between the committee substitute and the bill as
filed. Senator Zaffirini moved adoption of the committee
substitute; without objection, it was so ordered. Senator
Zaffirini moved that SB 31 do not pass but that CSSB 31 be
reported back to the Full Committee with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 4 ayes, 0 nay, 0 present not voting, and 2 absent.
The chair laid out SB 532. Senator Zaffirini moved that SB 532
be reported favorably to the Full Committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 2 absent.
The chair laid out SB 927. Senator Zaffirini moved adoption of
the committee substitute sent up by Senator West on April 18,
2005; without objection, it was so ordered. Senator Janek sent
up Committee Amendment 1 and moved adoption; without objection,
the amendment was adopted. Senator Janek requested unanimous
consent to incorporate amendments into the committee substitute;
without objection, it was so ordered. Senator West requested
unanimous consent to incorporate amendments into the committee
substitute; without objection, it was so ordered. Senator
Janek then moved that the new committee substitute be adopted;
without objection, it was so ordered. Senator Janek moved that
SB 927 do not pass but that CSSB 927 be reported back to the

The chair laid out SB 1227. Senator Zaffirini moved to pull
down Committee Substitute 1 sent up on April 11, 2005; without
objection, it was so ordered. Senator Zaffirini sent up
Committee Substitute 2; the chair recognized Senator Shapiro to
explain the difference between the committee substitute and the
bill as filed. Senator Zaffirini moved adoption of the
committee substitute; without objection, it was so ordered.
Senator Janek sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted. Senator West
requested unanimous consent to incorporate amendments into the
committee substitute; without objection, it was so ordered.

be reported back to the Full Committee with the recommendation

reported back to the Full Committee with the recommendation that

reported favorably to the Full Committee with the recommendation

There being no further business, at 1:48 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
