Pursuant to suspension of Senate Rule 11.18, a public hearing of
the Standing Senate Subcommittee on Higher Education was held on
Tuesday, April 12, 2005, in the Senate Chamber at Austin, Texas.

The posting rule, Senate Rule 11.18, was suspended to hear the
following bill(s): SB 30, SB 35, SB 95, SB 448, SB 676, SB
1034, SB 1228, SB 1529, SB 1716.
The chair called the meeting to order at 12:47 p.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 30 and recognized the author, Senator
Zaffirini, to explain the bill. Senator Zaffirini moved to
withdraw Committee Substitute 1, adopted on March 7, 2005;
without objection, it was so ordered. Senator Zaffirini sent up
a new committee substitute; the chair recognized Senator
Zaffirini to explain the difference between the committee
substitute and the bill as filed. Senator Zaffirini moved
adoption of the committee substitute; without objection, it was
so ordered. Senator Zaffirini moved that SB 30 do not pass but
that CSSB 30 be reported back to the Full Committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 5 ayes, 0 nay, 0 present not
voting, and 1 absent.
The chair laid out SB 39 and recognized the author, Senator
Zaffirini, to explain the bill. Senator Zaffirini sent up a
committee substitute; the chair recognized Senator Zaffirini to
explain the difference between the committee substitute and the
bill as filed. Senator Zaffirini moved adoption of the
committee substitute; without objection, it was so ordered.
Senator Zaffirini moved that SB 39 do not pass but that CSSB 39
be reported back to the Full Committee with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 5 ayes, 0 nay, 0 present not voting, and 1
absent.
The chair laid out SB 95 and recognized the author, Senator
Shapleigh, to explain the bill. Senator Averitt sent up
Committee Amendment 1 and moved adoption; without objection, the
amendment was adopted. Senator West requested unanimous consent
to roll the amendments into a committee substitute; without
objection, it was so ordered. Senator West then moved that the
committee substitute be adopted; without objection, it was so
ordered. Senator Averitt moved that SB 95 do not pass but that
CSSB 95 be reported back to the Full Committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 2 absent.

At 12:58 p.m. Senator Averitt assumed the chair.

West, to explain the bill. Senator West sent up a committee

filed. Senator West moved adoption of the committee substitute;
without objection, it was so ordered. Senator West moved that
SB 676 do not pass but that CSSB 676 be reported back to the
Full Committee with the recommendation that it do pass and be

reported favorably to the Full Committee with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 5 ayes, 0 nay, 0 present not voting, and 1
absent.
The chair laid out SB 1228 and recognized Senator West, in the
absence of the author, to explain the bill. Senator West sent
up Committee Amendment 1 and moved adoption; without objection,
the amendment was adopted. Senator West sent up Committee
Amendment 2 and moved adoption; without objection, the amendment
was adopted. Senator West requested unanimous consent to roll
the amendments into a committee substitute; without objection,
it was so ordered. Senator West then moved that the committee
substitute be adopted; without objection, it was so ordered.
Senator West moved that SB 1228 do not pass but that CSSB 1228
be reported back to the Full Committee with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 5 ayes, 0 nay, 0 present not voting, and 1
absent.
At 1:05 p.m. Senator West resumed the chair.
The chair laid out SB 1529 and recognized the author, Senator
Zaffirini, to explain the bill. Senator Zaffirini sent up a
committee substitute; the chair recognized Senator Zaffirini to
explain the difference between the committee substitute and the
bill as filed. Senator Zaffirini moved adoption of the
committee substitute; without objection, it was so ordered.
Senator Zaffirini sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted. Senator
West requested unanimous consent to incorporate amendments into
the committee substitute; without objection, it was so ordered.
Senator West then moved that the new committee substitute be
adopted; without objection, it was so ordered. Senator
Zaffirini moved that SB 1529 do not pass but that CSSB 1529 be
reported back to the Full Committee with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 4 ayes, 0 nay, 0 present not voting, and 2 absent.
The chair laid out SB 1716 and recognized the author, Senator
Van de Putte, to explain the bill. Senator Averitt moved that
SB 1716 be reported favorably to the Full Committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 2 absent.
There being no further business, at 1:12 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
