Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Standing Senate Subcommittee on
Higher Education was held on Monday, March 21, 2005, in the
Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 3:03 p.m. The clerk
called the roll; a quorum was not present.
The chair laid out SB 302 and recognized the author, Senator
Ellis, to explain the bill. Senator Averitt sent up a committee
substitute; the chair recognized Senator Ellis to explain the
difference between the committee substitute and the bill as
filed. Witnesses testifying and registering on the bill are
shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
A quorum was present at 3:10 pm.
Senator Averitt moved adoption of the minutes from the previous
hearings held on March 14, 2005, and March 16, 2005; without
objection, it was so ordered.
Senator Averitt moved adoption of the committee substitute for
SB 302; without objection, it was so ordered. Senator Zaffirini
moved that SB 302 do not pass but that CSSB 302 be reported back
to the Full Committee with the recommendation that it do pass
and be printed. The motion carried with a record vote of 4
ayes, 0 nay, 0 present not voting, and 2 absent.
At 3:14 p.m. Senator West moved that the committee stand
recessed until 5 minutes upon adjournment of the caucus.;
without objection, it was so ordered.
At 3:36 p.m. the committee reconvened.
The chair laid out SB 157 and recognized the author, Senator
Fraser, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that SB 157 be
left pending; without objection, it was so ordered.
The chair laid out SB 158 and recognized the author, Senator
Fraser, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that SB 158 be
left pending; without objection, it was so ordered.
The chair laid out SB 870 and recognized the author, Senator
Shapleigh, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that SB 870 be
left pending; without objection, it was so ordered.
The chair laid out SB 114 and recognized the author, Senator Van
de Putte, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that SB 114 be
left pending; without objection, it was so ordered.
There being no further business, at 4:49 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
