Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Standing Senate Subcommittee on
Higher Education was held on Monday, March 14, 2005, in the
Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 4:14 p.m. There being
a quorum present, the following business was transacted:
There was no action taken for the following bill(s): SB 67.
Senator Averitt moved adoption of the minutes from the previous
hearing held on March 7, 2005; without objection, it was so
ordered.
The chair laid out SB 448 and recognized the author, Senator
Zaffirini, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that SB 448 be
left pending; without objection, it was so ordered.
At 4:27 p.m. Senator Averitt assumed the chair.
The chair laid out SB 730 and recognized the author, Senator
West, to explain the bill. Senator West sent up a committee
substitute; the chair recognized Senator West to explain the
difference between the committee substitute and the bill as
filed. Witnesses testifying and registering on the bill are
shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.

objection, it was so ordered. Senator Averitt moved that SB 730
be left pending; without objection, it was so ordered.
At 4:46 p.m. Senator West resumed the chair.
The chair laid out SB 527 and recognized the author, Senator
Hinojosa, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Janek moved that SB 527
be reported favorably to the Full Committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 5 ayes, 0 nay, 0 present not
voting, and 1 absent.
The chair laid out SB 528 and recognized the author, Senator
Hinojosa, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that SB 528 be
left pending; without objection, it was so ordered.
The chair laid out SB 283 and recognized Senator Janek, in the
absence of the author, to explain the bill. The chair opened
public testimony; there being no witness cards, public testimony
was closed. Senator Janek moved that SB 283 be reported
favorably to the Full Committee with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 4 ayes, 0 nay, 0 present not voting, and 2 absent.
At 4:57 p.m. Senator Williams assumed the chair.
The chair laid out SB 530 and recognized the author, Senator
West, to explain the bill. Witnesses testifying and registering
on the bill are shown on the attached list. The chair moved
that the public testimony be closed; without objection, it was
so ordered. Senator Williams moved that SB 530 be left pending;
without objection, it was so ordered.
At 5:19 p.m. Senator West resumed the chair.
The chair laid out SB 702 and recognized the author, Senator
Deuell, to explain the bill. Senator Williams sent up a
committee substitute; the chair recognized Senator Deuell to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator West moved that SB 702 be left pending to await a
quorum; without objection, it was so ordered.
The chair laid out SB 511 and recognized the author, Senator
Deuell, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Janek moved that SB 511
be reported favorably to the Full Committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 2 absent.
Senator Williams moved adoption of the committee substitute for
SB 702; without objection, it was so ordered. Senator Williams
moved that SB 702 do not pass but that CSSB 702 be reported back
to the Full Committee with the recommendation that it do pass
and be printed. The motion carried with a record vote of 4
ayes, 0 nay, 0 present not voting, and 2 absent.
There being no further business, at 5:40 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
