Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Education was
held on Tuesday, May 3, 2005, in the Capitol Extension, Room
E1.028, at Austin, Texas.

The posting rule, Senate Rule 11.18, was suspended to hear the
following bill(s): SB 1194
The chair called the meeting to order at 8:45 a.m. The
following business was transacted:
The chair laid out SB 1120 and recognized the author, Senator
West, to explain the bill. Witnesses testifying and registering
on the bill are shown on the attached list. The chair moved
that the public testimony be closed; without objection, it was
so ordered. Senator Shapiro moved that SB 1120 be left pending
to await a quorum; without objection, it was so ordered.
The chair laid out SB 1248 and recognized the author, Senator
West, to explain the bill. Witnesses testifying and registering
on the bill are shown on the attached list. The chair moved
that the public testimony be closed; without objection, it was
so ordered. Senator Shapiro moved that SB 1248 be left pending
to await a quorum; without objection, it was so ordered.
The chair laid out HB 25 and recognized the Senate sponsor,
Senator Van de Putte, to explain the bill. Senator Van de Putte
sent up Committee Amendment 1. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Shapiro moved that HB 25
be left pending to await a quorum; without objection, it was so
ordered.
At 9:25 a.m. Senator Shapiro moved that the committee stand
recessed; without objection, it was so ordered.
The posting rule, Senate Rule 11.18, was suspended to hear the
following bills at Senator Shapiro's desk, upon adjournment of
the Senate: SB 1120, SB 1194, SB 1248, SB 1544, SB 1844, & HB

There was no action taken for the following bill: SB 1544 by
Senator West
At 3:30 p.m. the committee reconvened. There being a quorum
present, the clerk called the roll.
Senator Staples moved adoption of the minutes from the previous
hearing held on April 25, 2005; without objection, it was so
ordered.
The chair laid out SB 1120 by Senator West. Senator West moved
that SB 1120 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 8 ayes, 0 nay, 0 present not
voting, and 1 absent. Senator West moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The chair laid out SB 1248 by Senator West. Senator West moved
that SB 1248 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 8 ayes, 0 nay, 0 present not
voting, and 1 absent. Senator West moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The chair laid out HB 25 sponsored by Senator Van de Putte.
Senator Van de Putte sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted. Senator
Van de Putte moved that HB 25, as amended, be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 8 ayes, 0
nay, 0 present not voting, and 1 absent. Senator Van de Putte
moved that the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
The chair laid out SB 1194 by Senator Van de Putte. Senator Van
de Putte sent up a committee substitute; the chair recognized
Senator Van de Putte to explain the difference between the
committee substitute and the bill as filed. Senator Van de
Putte moved adoption of the committee substitute; without
objection, it was so ordered. Senator Van de Putte moved that
SB 1194 do not pass but that CSSB 1194 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 6 ayes, 2 nays, 0
present not voting, and 1 absent.
The chair laid out SB 1844 by Senator Harris. Senator West then
moved adoption of the subcommittee report; there being no
objection, it was so ordered. Senator West moved that SB 1844
do not pass but that CSSB 1844 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a record vote of 8 ayes, 0 nay, 0 present
not voting, and 1 absent. Senator West moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
There being no further business, at 3:40 p.m. Senator Shapiro
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
