Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on
Intergovernmental Relations was held on Wednesday, March 9,
2005, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 9:03 a.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 466 and recognized the author, Senator
Fraser, to explain the bill. Senator Deuell sent up a committee
substitute; the chair recognized Senator Fraser to explain the
difference between the committee substitute and the bill as
filed. Senator Deuell moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Madla moved that SB 466
be left pending to await a quorum; without objection, it was so
ordered. Upon arrival of a quorum, Senator Deuell moved that SB
466 do not pass but that CSSB 466 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a record vote of 5 ayes, 0 nay, 0 present
not voting, and 0 absent. Senator Deuell moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The chair laid out SB 541 and recognized the author, Senator
Seliger, to explain the bill. Senator Deuell sent up a
committee substitute; the chair recognized Senator Seliger to
explain the difference between the committee substitute and the
bill as filed. Senator Deuell moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses

moved that SB 541 do not pass but that CSSB 541 be reported back
to the Senate with the recommendation that it do pass and be

chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Gallegos, Jr. moved that
SB 118 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 1 absent. Senator Gallegos, Jr. moved that the bill
be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.

Madla , to explain the bill. Senator Madla sent up Committee
Amendment 1 and moved adoption; without objection, the amendment
was adopted. Witnesses registering on the bill are shown on the
attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered. Senator Madla
requested unanimous consent to roll the amendment into a
committee substitute; without objection, it was so ordered.
Senator Madla then moved that the committee substitute be
adopted; without objection, it was so ordered. Senator Madla
moved that SB 571 do not pass but that CSSB 571 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 5 ayes, 0 nay,
0 present not voting, and 0 absent. Senator Madla moved that the
bill be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.

The chair laid out CSSB 313 which had been left pending from a
previous hearing and recognized the author, Senator Gallegos,
Jr. Senator Gallegos, Jr. sent up Committee Amendment 1 and
moved adoption; without objection, the amendment was adopted.
Senator Gallegos, Jr. requested unanimous consent to roll the
amendment into a committee substitute; without objection, it was
so ordered. Senator Gallegos, Jr. then moved that the committee
substitute be adopted; without objection, it was so ordered.
Senator Gallegos, Jr. moved that SB 313 do not pass but that
CSSB 313 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 5 ayes, 0 nay, 0 present not voting, and 0
absent.
There was no action taken for the following bill(s): SJR 14
There being no further business, at 10:12 a.m. Senator Madla
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
