H.B. No. 1791
AN ACT
relating to application of the hazing statutes to private
institutions of higher education; providing penalties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 51.936, Education Code, is amended by
amending Subsections (a) and (b) and adding Subsection (e) to read
as follows:
(a) Subchapter F, Chapter 37, applies to a postsecondary
[hazing at an] educational institution under this section in the
same manner as that subchapter applies to a public or private high
school.
(b) For purposes of this section, [in Subchapter F, Chapter
37,] "postsecondary educational institution" means:
(1) an institution of higher education as defined by
Section 61.003;
(2) a private or independent institution of higher
education as defined by Section 61.003; or
(3) a private postsecondary educational institution
as defined by Section 61.302.
(e) Section 1.001(a) does not limit the application of this
section to postsecondary educational institutions supported in
whole or in part by state tax funds.
SECTION 2. This Act takes effect September 1, 2005.
