Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Infrastructure Development
and Security Committee was held on Friday, May 23, 2003, in the
Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 2:43 p.m. There being
a quorum present, the following business was transacted:
At 2:53 p.m. Senator Barrientos assumed the chair.
The chair laid out HB 471, relating to the borrowing of money
and the issuance of notes by the Texas Transportation
Commission; making an appropriation, which had been left pending
at previous hearing. Senator Ogden sent up a committee
substitute; the chair recognized Senator Ogden to explain the
difference between the committee substitute and the bill as
filed. Senator Ogden moved adoption of the committee
substitute; without objection, it was so ordered. Senator Ogden
moved that HB 471 do not pass but that CSHB 471 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 7 ayes, 0
nay, 0 present not voting, and 2 absent.
The chair laid out HJR 28, proposing a constitutional amendment
providing for authorization of the issuing of notes or the
borrowing of money on a short-term basis by a state
transportation agency for transportation-related projects, which
had been left pending at a previous hearing. Senator Ogden sent
up a committee substitute; the chair recognized Senator Ogden to
explain the difference between the committee substitute and the
bill as filed. Senator Ogden moved adoption of the committee
substitute; without objection, it was so ordered. Senator Ogden
moved that HJR 28 do not pass but that CSHJR 28 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 7 ayes, 0
nay, 0 present not voting, and 2 absent.
The chair laid out HB 3588, relating to the construction,
acquisition, financing, maintenance, management, operation,
ownership, and control of transportation facilities and the
progress, improvement, policing, and safety of transportation in
the state, which had been left pending at a previous hearing.
Senator Ogden sent up a committee substitute; the chair
recognized Senator Ogden to explain the difference between the
committee substitute and the bill as filed. Senator Ogden moved
adoption of the committee substitute; without objection, it was
so ordered. Senator Ogden moved that HB 3588 do not pass but
that CSHB 3588 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 5 ayes, 0 nay, 0 present not
voting, and 4 absent.
At 3:10 p.m. Senator Ogden resumed the chair.
The chair laid out HB 2006, relating to the construction and
maintenance of utility, common carrier, and energy transporter
facilities along, over, under, or across a railroad
right-of-way, which had been left pending at a previous hearing.
Senator Ogden moved to pull down a committee substitute which
had been sent up and adopted at a previous hearing; without
objection, it was so ordered. Senator Shapleigh sent up a
committee substitute; the chair recognized Senator Shapleigh to
explain the difference between the committee substitute and the
bill as filed. Senator Shapleigh moved adoption of the
committee substitute; without objection, it was so ordered.
Senator Shapleigh moved that HB 2006 do not pass but that CSHB
2006 be reported back to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent.
At 3:19 p.m. Senator Barrientos assumed the chair.
The chair laid out HB 3343, relating to the coordination of
statewide public transportation by the Texas Transportation
Commission and the Texas Department of Transportation, which had
been left pending at a previous hearing. Senator Wentworth sent
up Committee Amendment 1 and moved adoption; without objection,
the amendment was adopted. Senator Wentworth sent up Committee
Amendment 2 and moved adoption; without objection, the amendment
was adopted. Senator Madla sent up Committee Amendment 3 and
moved adoption; without objection, the amendment was adopted.
Senator Shapiro sent up Committee Amendment 4 and moved
adoption; without objection, the amendment was adopted. Senator
Ogden moved that HB 3343 be left pending; without objection, it
was so ordered.
At 3:39 p.m. Senator Madla assumed the chair.
The chair laid out HB 814, relating to motor vehicle financial
responsibility; providing penalties, which had been left pending
at a previous hearing. Senator Ogden sent up a committee
substitute; the chair recognized Senator Ogden to explain the
difference between the committee substitute and the bill as
filed. Senator Ogden moved to withdraw the committee
substitute; without objection, it was so ordered. Senator
Lindsay sent up a committee substitute; the chair recognized
Senator Lindsay to explain the difference between the committee
substitute and the bill as filed. Senator Lindsay moved
adoption of the committee substitute; the motion to adopt
failed. Senator Barrientos moved that HB 814 be reported
favorably to the Senate with the recommendation that it do pass
and be printed. The motion carried with a record vote of 6
ayes, 1 nay, 0 present not voting, and 2 absent.
The following bill had no action taken in committee: HB 3185 by
Hill/Staples.
There being no further business, at 4:00 p.m. Senator Ogden
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
