Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Standing Senate Subcommittee on
Higher Education was held on Monday, May 19, 2003, in the Betty
King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 3:44 p.m. There being
a quorum present, the following business was transacted:
Senator Averitt moved adoption of the minutes from the previous
hearing held on May 5, 2003; without objection, it was so
ordered.
The chair laid out HB 256 and recognized the Senate sponsor,
Senator Shapiro, to explain the bill. Senator Averitt moved
that HB 256 be reported favorably to the full committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 5 ayes, 0 nay, 0 present not
voting, and 0 absent.
The chair laid out HB 2379 and recognized the Senate sponsor,
Senator Shapiro, to explain the bill. Senator Janek sent up a
committee substitute; the chair recognized Senator Shapiro to
explain the difference between the committee substitute and the
bill as filed. Senator Janek moved adoption of the committee
substitute; without objection, it was so ordered. Senator West
moved that HB 2379 be left pending the arrival of the committee
amendment; without objection, it was so ordered.
The chair laid out HB 2457 and recognized the Senate sponsor,
Senator Lucio, Jr., to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West moved that HB 2457
be left pending the arrival of the committee amendment; without
objection, it was so ordered.
Upon arrival of the committee amendment to HB 2379, Senator
Janek sent up Committee Amendment 1, and moved adoption; without
objection, the amendment was adopted. Senator Janek requested
unanimous consent to incorporate the amendment into the
committee substitute; without objection, it was so ordered.
Senator Janek then moved that the new committee substitute be
adopted; without objection, it was so ordered. Senator Janek
moved that HB 2379 do not pass but that CSHB 2379 be reported
back to the full committee with the recommendation that it do
pass and be printed. The motion carried with a record vote of 5
ayes, 0 nay, 0 present not voting, and 0 absent.
At 3:58 p.m. Senator Averitt assumed the chair.
The chair laid out HB 1566 and recognized Senator West, in the
absence of the Senate sponsor, to explain the bill. Senator
Janek sent up a committee substitute; the chair recognized
Senator West to explain the difference between the committee
substitute and the bill as filed. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Averitt moved that HB
1566 be left pending; without objection, it was so ordered.
At 4:00 p.m. Senator West resumed the chair.
Upon arrival of the committee amendment to HB 2457, Senator
Janek sent up Committee Amendment 1 and moved adoption; without
objection, the amendment was adopted. Senator Janek moved that
HB 2457, as amended, be reported back to the full committee with
the recommendation that it do pass and be printed. The motion
carried with a record vote of 5 ayes, 0 nay, 0 present not
voting, and 0 absent.

absence of the Senate sponsor, to explain the bill. Senator
Janek sent up Committee Amendment 1 and moved adoption; without

quorum; without objection, it was so ordered.
The chair laid out HB 757 and recognized Senator Janek, in the
absence of the Senate sponsor, to explain the bill. Senator Van
de Putte moved that HB 757 be reported favorably to the full
committee with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent.
Upon arrival of a quorum, Senator Janek moved adoption of the
committee substitute on HB 1420; without objection, it was so
ordered. Senator Janek moved that HB 1420 do not pass but that
CSHB 1420 be reported back to the full committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 5 ayes, 0 nay, 0 present not
voting, and 0 absent.
Senator Janek sent up Committee Amendment 1 on HB 1566 and moved
adoption; without objection, the amendment was adopted. Senator
Janek previously sent up a committee substitute. Senator Janek
moved adoption of the committee substitute; without objection,
it was so ordered. Senator Janek requested unanimous consent to
incorporate the amendment into the committee substitute; without
objection, it was so ordered. Senator Janek then moved that the
new committee substitute be adopted; without objection, it was
so ordered. Senator Janek moved that HB 1566 do not pass but
that CSHB 1566 be reported back to the full committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 1 absent.
There being no further business, at 4:45 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
