         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Tuesday, September 7, 2004, in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:12 a.m.  The  
         following business was transacted:   
          
         Witnesses testifying and registering on Charge #5 are shown on  
         the attached list.   
          
         At 9:39 a.m. there being a quorum present, the clerk called a  
         roll call. 
          
         Senator West moved adoption of the minutes from the previous  
         hearing held on August 23, 2004; without objection it was so  
         ordered. 
          
         At 10:48 a.m. Senator West assumed the chair.   
          
         At 10:50 a.m. Senator Shapiro resumed the chair. 
          
         Witnesses testifying and registering on Charge #7 are shown on  
         the attached list.  
          
         At 12:20 p.m. Senator West assumed the chair.   
         At 12:46 p.m. Senator Shapiro resumed the chair. 
           
         Witnesses testifying and registering on Charge #1 and Charge #6  
         are shown on the attached list. 
          
         Witnesses testifying and registering on Charge #2 are shown on  
         the attached list.     
          
         The chair moved that the invited and public testimony be closed;  
         without objection, it was so ordered.   
          
         There being no further business, at 3:53 p.m. Senator Shapiro  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
