Amend CSHB 1606 as follows:
(1) Between Sections 4.03 and 4.04 of the bill (Senate
committee report, page 23, between lines 60 and 61), insert the
following new section, appropriately numbered:
SECTION 4.___. Subchapter A, Chapter 305, Government Code,
is amended by adding Section 305.0031 to read as follows:
Sec. 305.0031. PERSONS INELIGIBLE TO REGISTER. A person is
not eligible to register or to renew a registration under this
chapter if:
(1) the person has been convicted of a felony in any
jurisdiction; or
(2) the person has been convicted in a jurisdiction
other than this state of an offense other than a felony, if the
offense would be a felony if committed in this state.
(2) Between Sections 4.10 and 4.11 of the bill (Senate
committee report, page 25, between lines 61 and 62), insert the
following new section, appropriately numbered:
SECTION 4.___. Subchapter F, Chapter 411, Government Code,
is amended by adding Section 411.1006 to read as follows:
Sec. 411.1006. ACCESS TO CRIMINAL HISTORY RECORD
INFORMATION: TEXAS ETHICS COMMISSION. (a) The Texas Ethics
Commission is entitled to obtain from the department criminal
history record information maintained by the department that
relates to a person who applies for registration or renewal of
registration under Chapter 305.
(b) Criminal history record information obtained by the
commission under Subsection (a) may not be released or disclosed to
any person, except on court order or with consent of the applicant.
(3) Renumber the sections of Article 4 of the bill
accordingly.
