Amend the Wolens amendment No. 1 to CSHB 1606 as follows:
(1) On page 39 of the amendment, between lines 1 and 2,
insert the following:
SECTION 2.19. Chapter 254, Election Code, is amended by
adding Subchapter J to read as follows:
SUBCHAPTER J. REPORTING BY INDIVIDUALS
Sec. 254.251. THRESHOLD FOR REPORTING REQUIREMENT. An
individual shall file a report with the commission if the
individual makes political contributions that in the aggregate
exceed $25,000 in a calendar year to one or more candidates,
officeholders, or political committees.
Sec. 254.252. CONTENTS OF REPORT. (a) Each report required
by this subchapter must include, for each political contribution
made during the reporting period by the individual filing the
report:
(1) the full name and address of the person to whom the
contribution is made;
(2) the date of the contribution; and
(3) the amount of the contribution.
(b) Section 254.031 does not apply to a report under this
subchapter.
Sec. 254.253. REPORTING SCHEDULE FOR INDIVIDUAL. (a) An
individual shall file a report under this subchapter not later than
the fifth day after the date the individual makes a political
contribution that causes the aggregate amount of political
contributions made by the individual to exceed the threshold
prescribed by Section 254.251.
(b) A report under Subsection (a) covers the period
beginning on the day the individual made the first political
contribution in the calendar year and continuing through the day
the individual makes a political contribution that causes the
aggregate amount of political contributions made by the individual
to exceed the threshold prescribed by Section 254.251.
(c) If the individual exceeds the threshold prescribed by
Section 254.251 on or after January 1 and before July 1, the person
shall file two additional reports for the calendar year. The first
report shall be filed not later than July 15. The report covers the
period beginning January 1 and continuing through June 30. The
second report shall be filed not later than January 15. The report
covers the period beginning July 1 and continuing through December
31.
(d) If the individual exceeds the threshold prescribed by
Section 254.251 on or after July 1, the person shall file one
additional report for the calendar year. The report shall be filed
not later than January 15. The report covers the period beginning
July 1 and continuing through December 31.
Sec. 254.254. APPOINTMENT OF CAMPAIGN TREASURER NOT
REQUIRED. An individual required under this subchapter to file
reports is not required to file a campaign treasurer appointment.
Sec. 254.255. OFFENSE. (a) A person commits an offense if
the person knowingly fails to comply with this subchapter.
(b) An offense under this section is a Class A misdemeanor.
(2) On page 41 of the amendment, between lines 16 and 17,
insert the following:
(e) Subchapter J, Chapter 254, Election Code, as added by
this Act, applies only to the reporting of a political contribution
made on or after September 1, 2003. A political contribution made
before September 1, 2003, is covered by the law in effect at the
time the contribution was made and is not aggregated with political
contributions made on or after that date.
(3) On page 41 of the amendment, line 17, strike "(e)" and
substitute "(f)".
(4) On page 41 of the amendment, line 24, strike "(f)" and
substitute "(g)".
(5) Renumber the sections of Article 2 accordingly.
