Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Jurisprudence
was held on Monday, February 19, 2001, in the Capitol Extension,
Room E1.012, at Austin, Texas.

The chair called the meeting to order at 2:25 p.m. There being
a quorum present, the following business was transacted:

Senator Duncan moved adoption of the minutes from the previous
hearings held on February 12, 2001, and February 13, 2001;
without objection, it was so ordered.
At 2:26 p.m. Senator Bernsen assumed the chair.
The chair laid out SB250 and recognized Senator West, in the
absence of the author, to explain the bill. Senator West sent
up a committee substitute; the chair recognized Senator West to
explain the difference between the committee substitute and the
bill as filed. Senator West moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator West moved that
SB250 do not pass but that CSSB250 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 6 ayes, 0 nay, 0
present not voting, and 1 absent.
The chair laid out SB678 and recognized the author, Senator
West, to explain the bill. Senator West sent up a committee
substitute; the chair recognized Senator West to explain the
difference between the committee substitute and the bill as
filed. Senator West moved adoption of the committee substitute;
without objection, it was so ordered. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator West requested unanimous
consent to incorporate Committee Amendment 1 into the committee
substitute; without objection, it was so ordered. Senator West
then moved that the new committee substitute be adopted; without
objection, it was so ordered. Senator West moved that SB678 do
not pass but that CSSB678 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion
carried with a record vote of 7 ayes, 0 nay, 0 present not
voting, and 0 absent.
At 3:07 p.m. Senator West resumed the chair.
The chair laid out SB148 and recognized the author, Senator
Shapiro, to explain the bill. Senator Duncan sent up a
committee substitute; the chair recognized Senator Shapiro to
explain the difference between the committee substitute and the
bill as filed. Senator Duncan moved adoption of the committee
substitute; without objection, it was so ordered. There was no
public testimony on this bill. Senator Duncan moved that SB148
do not pass but that CSSB148 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion
carried with a record vote of 7 ayes, 0 nay, 0 present not
voting, and 0 absent. Senator Bernsen moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.

West. Senator West asked to reconsider the vote on CSSB 678;
without objection, it was so ordered. Senator West asked to
reconsider the vote on Committee Amendment 1 for CSSB 678;
without objection, it was so ordered. Senator West asked that
Committee Amendment 1 to CSSB 678 do no pass; without
objection, it was so ordered. Senator West asked that Committee
Amendment 1 to CSSB 678 be tabled; without objection, it was so
ordered. Senator West moved that SB678 do not pass but that
CSSB678 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 7 ayes, 0 nay, 0 present not voting, and 0
absent. Senator West moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.

Ogden, to explain the bill. Witnesses testifying and

objection, it was so ordered. Senator Brown moved that SB370 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote

Wentworth, to explain the bill. Witnesses testifying and

recommendation that it do pass and be printed. The motion

The chair laid out SB120 and recognized the author, Senator
Wentworth. Senator Wentworth sent up Committee Amendment 1 and
moved adoption; without objection, the amendment was adopted.
Senator Wentworth moved that SB120, as amended, be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 6 ayes, 0
nay, 0 present not voting, and 1 absent. Senator Wentworth
moved that the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
There being no further business, at 4:40 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
