Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Border
Affairs - Special was held on Thursday, April 22, 1999 in the
Capitol Building, Room 2E.20, at Austin, Texas.

The Chair called the meeting to order at 8:40 am. There being
a quorum present, the following business was transacted.
The following members arrived after the roll was called:
Senator Sibley, Senator Bivins.
The Chair moved to adopt the minutes from April 15, 1999 and
April 16, 1999. There was no objection.
The Chair announced that the Committee would hold the votes
open on all the bills until it was close to the end of the
hearing. There was no objection.
At 8:41 am Senator Truan assumed the chair.
Senator Truan laid out SJR 34 and recognized the author,
Senator Lucio, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Truan laid out SB 1287 and recognized the author,
Senator Lucio, to explain the bill. Senator Lucio sent up a
committee substitute; Senator Truan recognized Senator Lucio
to explain the difference between the committee substitute and
the bill as filed.

the attached list.
At 8:50 am Senator Sibley assumed the chair.
Senator Sibley laid out SJR 45 and recognized the author,
Senator Lucio, to explain the bill. Senator Lucio sent up a
committee substitute; Senator Sibley recognized Senator Lucio
to explain the difference between the committee substitute and
the bill as filed.
Witnesses testifying and registering on the bill are shown on

Senator Sibley laid out SB 966 and recognized the author,
Senator Lucio, to explain the bill. Senator Lucio sent up a
committee substitute; Senator Sibley recognized Senator Lucio
to explain the difference between the committee substitute and
the bill as filed.

Senator Lucio moved adoption of the committee substitute for
SB 1287, without objection, it was so ordered.
Senator Lucio moved adoption of the committee substitute for
SB 966, without objection, it was so ordered.
Senator Lucio moved adoption of the committee substitute for
SJR 45, without objection, it was so ordered.
Senator Lucio moved that SJR 45 do not pass but that CSSJR 45
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 5
ayes, 0 nays, 0 present not voting, and 2 absent.
Senator Lucio moved that SB 966 do not pass but that CSSB 966
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 5
ayes, 0 nays, 0 present not voting, and 2 absent.
Senator Lucio moved that SJR 34 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 5 ayes, 0 nays, 0 present
not voting, and 2 absent.
Senator Lucio moved that SB 1287 do not pass but that CSSB
1287 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent.
At 9:40 am Senator Lucio resumed the chair.
The Chair laid out SCR 40 and recognized the author, Senator
Shapleigh, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
At 9:46 am the Chair moved that the Committee stand at ease to
wait for a quorum.
At 9:48 am the Committee reconvened.
Senator Shapleigh moved that SCR 40 be reported favorably to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 5 ayes, 0 nays, 0
present not voting, and 2 absent.
Senator Zaffirini moved adoption of the minutes from the
hearings on April 15, 1999 and April 16, 1999. Without
objection, it was so ordered.
Senator Shapleigh moved that the Committee stand recessed
subject to the call of the Chair. Without objection, it was
so ordered.
The Chair called the meeting to order at 12:22 pm. There
being a quorum present, the following business was transacted.
The Chair laid out HB 165 and recognized the Senate sponsor,
Senator Bivins, to explain the bill.
Senator Bivins moved that HB 165 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 6 ayes, 0 nays, 0 present
not voting, and 1 absent. Senator Zaffirini moved that the
bill be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
There being no further business, at 12:25 pm Senator Zaffirini
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
