Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Border
Affairs - Special was held on Tuesday, April 6, 1999 in the
Capitol Extension, Room E1.028, at Austin, Texas.

The Chair called the meeting to order at 8:10 am. There being
a quorum present, the following business was transacted.
The following members arrived after the roll was called:
Senator Bivins, Senator Shapleigh
Senator Zaffirini moved that the Minutes from the previous
hearing be adopted; without objection, it was so ordered.
Chairman Lucio gave opening remarks.
At 8:12 am Senator Zaffirini assumed the chair.
Senator Zaffirini laid out SB1421 and recognized the author,
Senator Lucio, to explain the bill. Senator Lucio explained SB
1421 and the committee substitute for SB 1421. Senator Truan
sent up the committee substitute. Senator Truan moved
adoption of the committee substitute, without objection, it
was so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Lucio made remarks thanking everyone who worked on the
Committee Substitute for SB 1421. He thanked the staff of the
Co-Authors for the bill, the Lieutenant Governor and his
staff, and the Governor's office, through the Secretary of
State. He also thanked the Attorney General's Office, the
Texas Water Development Board, and Valley Interfaith.
Senator Lucio moved that SB 1421 do not pass but that CSSB
1421 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.
At 8:50 am Senator Lucio resumed the chair.
The Chair laid out SB 304 and recognized the author, Senator
Truan, for a motion. Senator Truan moved that SB 304 be left
on the table subject to call. Without objection, it was so
ordered.
Senator Truan asked to reconsider his motion, without
objection it was so ordered.
Senator Truan moved that SB 304 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 6 ayes, 0 nays, 0 present
not voting, and 1 absent.
The Chair laid out SB 630 and recognized the author, Senator
Truan.
Senator Truan moved that SB 630 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 6 ayes, 0 nays, 0 present
not voting, and 1 absent.
The Chair laid out SB 715 and recognized the author, Senator
Truan.
Senator Truan moved that SB 715 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 6 ayes, 0 nays, 0 present
not voting, and 1 absent.

At 8:53 am Senator Zaffirini assumed the chair.
Senator Zaffirini laid out SB1284 and recognized the author,
Senator Lucio, to explain the bill. Senator Lucio explained SB
1284 and the committee substitute for SB 1284. Senator Lucio
sent up the committee substitute. Senator Lucio moved
adoption of the committee substitute, without objection, it
was so ordered.
Senator Lucio moved that SB 1284 do not pass but that CSSB
1284 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.
At 8:56 am Senator Lucio resumed the chair.
The Chair laid out SB 1410, SB 1411, and SB 1412 and
recognized the author, Senator Zaffirini to explain the bills.
Senator Zaffirini explained the committee substitutes that
were adopted at the previous hearing for SB 1410, SB 1411, and
SB 1412. Senator Zaffirini stated that each bill had been
amended.
Senator Zaffirini moved that the amendment for SB 1410 be
adopted and rolled into a new committee substitute and that
the committee substitute be adopted. Without objection, it
was so ordered.

Senator Zaffirini moved that SB 1410 do not pass but that CSSB
1410 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.
Senator Zaffirini moved that the amendment for SB 1411 be
adopted and rolled into a new committee substitute and that
the committee substitute be adopted. Without objection, it
was so ordered.
Senator Zaffirini moved that SB 1411 do not pass but that CSSB
1411 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.
Senator Zaffirini moved that the amendment for SB 1412 be
adopted and rolled into a new committee substitute and that
the committee substitute be adopted. Without objection, it
was so ordered.
Senator Zaffirini moved that SB 1412 do not pass but that CSSB
1412 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.
Senator Bivins acknowledged that the Committee did not open or
close public testimony on SB 304, SB 630, and SB 715. Senator
Bivins moved that the Committee allow for open public
testimony for SB 304, SB 630, and SB 715. Without objection,
it was so ordered.
The Chair laid out SB 304, SB 630, SB 715, and SB 1503 and
recognized the author, Senator Truan, to explain the bills.
Senator Truan moved that SB 304 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 5 ayes, 0 nays, 0 present
not voting, and 2 absent.
Senator Truan moved that SB 630 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 5 ayes, 0 nays, 0 present
not voting, and 2 absent.
Senator Truan moved that SB 715 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 5 ayes, 0 nays, 0 present
not voting, and 2 absent.
Senator Truan moved that SB 1503 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 6 ayes, 0 nays, 0 present
not voting, and 1 absent.
There being no further business, at 9:15 am Senator Shapleigh
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
