Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Health
Services was held on Tuesday, May 4, 1999, in the Capitol
Extension, Room E1.016, at Austin, Texas.

At the request of the Chair, Senator Nixon called the meeting
to order at 1:30 p.m. The last vote of the committee
reflecting a quorum being present, the following business was
transacted.
The following members arrived after the roll was called:
none.
The Chair laid out HB 2827 and recognized Rep. Isett, in the
absence of the Senate sponsor, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
The Chair moved that HB 2827 be left pending to await a
quorum; without objection, it was so ordered. Upon arrival of
a quorum, Senator Nixon moved that HB 2827 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 4 ayes, 0 nays, 0
present not voting, and 1 absent.
Senator Nixon moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
The Chair laid out SB 1891 and recognized Rep. Garcia, in the
absence of the author, to explain the bill.

At 1:58 p.m., Senator Nelson assumed the chair.
The Chair moved that SB 1891 be left pending; without
objection, it was so ordered.
The Chair laid out SB 905 and recognized the bill's author,
Senator Bernsen, to explain the bill.
Senator Nixon sent up a committee substitute; the Chair
recognized Senator Bernsen to explain the difference between
the committee substitute and the bill as filed.

The Chair moved that SB 905 be left pending; without
objection, it was so ordered.
The Chair laid out the April 27,1999, minutes and recognized
Senator Nixon who moved for their approval. There being no
objection, the motion prevailed by unanimous consent.
At 2:50 p.m., Senator Nixon assumed the chair.
The Chair laid out SB 1889 and recognized the bill's author,
Senator Nelson, to explain the bill.

Senator Madla sent up a committee substitute; the Chair
recognized Senator Madla to explain the difference between the
committee substitute and the bill as filed. Senator Madla
then moved that the committee substitute be adopted; without
objection, it was so ordered.

and recognized the author, Senator Carona, to explain the
bill.
Senator Madla had previously sent up Committee Amendment 1
which had been adopted.
Senator Nixon now sent up Committee Amendment 2 and moved
adoption; without objection, the amendment was adopted.
Senator Nixon then sent up Committee Amendment 3 and moved
adoption; without objection, the amendment was adopted.
Senator Madla requested unanimous consent to incorporate
amendments into a new committee substitute; without
objection, it was so ordered.
Senator Madla then moved that the new committee substitute be
adopted; without objection, it was so ordered.
Senator Madla moved that SB 1156 do not pass, but that CSSB
1156 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.
Senator Madla moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
At 5:44 p.m., Senator Madla assumed the chair.
The Chair laid out HB 1677 and recognized Senator Nelson, in
the absence of the Senate sponsor, to explain the bill.

The Chair laid out SB 941 which had been previously heard in
committee and recognized Senator Nelson, in the absence of the
author, to explain the bill.

At 5:55 p.m., Senator Nelson resumed the chair.
The Chair laid out HB 1491 and recognized the Senate sponsor,
Senator Ellis, to explain the bill.

committee and recognized the author, Senator Bernsen.
Senator Madla sent up a new committee substitute; the Chair
recognized Senator Bernsen to explain the difference between
the new committee substitute and the bill as filed.
Senator Lindsay sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Senator Madla requested unanimous consent to incorporate the
amendment into the new committee substitute; without
objection, it was so ordered. Senator Madla then moved that
the new committee substitute be adopted; without objection, it
was so ordered.
Senator Madla moved that SB 905 do not pass, but that CSSB 905
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 4
ayes, 0 nays, 0 present not voting, and 1 absent.
The Chair laid out SB 1811 and left it pending.
There being no further business, at 6:41 p.m., Senator Madla
moved that the Committee stand recessed, subject to the call
of the Chair. Without objection, it was so ordered.
