Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Health
Services was held on Tuesday, March 23, 1999, in the Capitol
Extension, Room E1.016, at Austin, Texas.

The Chair called the meeting to order at 1:30 p.m. There
being a quorum present, the following business was transacted.
The following members arrived after the roll was called:
Senator Moncrief and Senator Madla.
The Chair laid out the March 16, 1999, minutes and recognized
Senator Moncrief who moved for their approval. There being no
objection, the motion prevailed by unanimous consent.
The Chair laid out SB 862 and recognized the bill's author,
Senator Gallegos, Jr., to explain the bill.
Senator Nixon sent up a committee substitute; the Chair
recognized Senator Gallegos to explain the difference between
the committee substitute and the bill as filed.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Nelson sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Senator Moncrief requested unanimous consent to incorporate
the committee amendment into the committee substitute;
without objection, it was so ordered.
Senator Moncrief then moved that the new committee substitute
be adopted; without objection, it was so ordered. Senator
Moncrief moved that SB 862 do not pass, but that CSSB 862 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a vote of 5
ayes, 0 nays, 0 present not voting, and 0 absent.
The Chair laid out SB 676 and recognized the bill's author,
Senator Lucio, Jr., to explain the bill.
Senator Madla sent up a committee substitute; the Chair
recognized Senator Lucio to explain the difference between the
committee substitute and the bill as filed. Senator Madla
moved adoption of the committee substitute; without objection,
it was so ordered.

that it do pass and be printed. The motion carried with a
vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.
Senator Moncrief moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
At 4:12 p.m., Senator Moncrief assumed the chair.

The Chair laid out SB 51 which had been left pending before
the committee and recognized the bill's author, Senator
Nelson, to explain the committee substitute, CSSB 51,
previously adopted in committee. Discussion was on the
committee substitute.
Senator Moncrief sent up Committee Amendment 1 and moved
adoption; Senator Moncrief then withdrew his amendment.
Senator Nelson then moved that SB 51 do not pass, but that
CSSB 51 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 3 ayes, 1 nay, 0 present not voting, and 1 absent.
At 5:00 p.m., Senator Nelson resumed the chair.
The Chair laid out SB 673 and recognized the bill's author,
Senator Moncrief, to explain the bill.

Senator Moncrief moved that SB 673 be reported favorably to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 4 ayes, 0 nays, 0

placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
The Chair laid out SB 1198 which had been left pending before
the committee and recognized the bill's author, Senator
Moncrief, to explain the bill.
Senator Moncrief sent up a committee substitute; the Chair
recognized Senator Moncrief to explain the difference between
the committee substitute and the bill as filed.

Senator Nixon sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Senator Moncrief requested unanimous consent to incorporate
the amendment into the committee substitute; without
objection, it was so ordered.
Senator Moncrief then moved that the new committee substitute
be adopted; without objection, it was so ordered. Senator
Moncrief moved that SB 1198 do not pass, but that CSSB 1198 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a vote of 5
ayes, 0 nays, 0 present not voting, and 0 absent.
Senator Moncrief moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
The Chair laid out the committee substitute for SB 676 which
was previously adopted and recognized Senator Madla who moved
that SB 676 do not pass, but that CSSB 676 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 4 ayes, 1 nay, 0
present not voting, and 0 absent.
There being no further business, at 5:20 p.m., Senator Nelson
moved that the Committee stand recessed, subject to the call
of the Chair. Without objection, it was so ordered.
