Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Health
Services, Subcommittee on SB 93, was held on Thursday,
February 25, 1999, in the Capitol Extension, Room E1.016, at
Austin, Texas.

Senator Moncrief, Chair of the Subcommittee on SB 93, called
the meeting to order at 9:03 a.m. There being a quorum
present, the following business was transacted.
The following members arrived after the roll was called:
none.
The Chair laid out SB 93 and explained the bill which was
previously heard in full committee. Senator Moncrief sent up
a committee substitute for SB 93 and laid it out for
consideration.
The following witnesses served as resource witnesses on the
bill:
Marc Gold, Director of Long Term Care Policy, representing
the Texas Department of Human Services, testified on the bill.
Jim Lehrman, representing the Texas Department of Human
Services, testified on the bill.
The Chair recognized Senator Nixon who sent up a committee
amendment to explain his amendment. The Chair then recognized
Senator Nixon who withdrew his amendment.
Senator Moncrief then sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
The Chair recognized Senator Nixon who sent up a committee
amendment to explain his amendment. The Chair then recognized
Senator Nixon who withdrew his amendment.
The Chair recognized Senator Nixon who sent up another
committee amendment to explain his amendment. The Chair then
recognized Senator Nixon who withdrew his amendment.
Senator Moncrief then sent up Committee Amendment 2 and moved
adoption; without objection, the amendment was adopted.
Senator Nixon then sent up Committee Amendment 3 and moved
adoption; without objection, the amendment was adopted.
The Chair recognized Senator Nixon who sent up a committee
amendment to explain his amendment. The motion to adopt the
amendment failed by a vote of 1 aye, 2 nays, 0 present not
voting, and 0 absent.
Senator Moncrief sent up Committee Amendment 4 and moved
adoption; without objection, the amendment was adopted.
Senator Nixon sent up Committee Amendment 5 and moved
adoption; without objection, the amendment was adopted.
The Chair recognized Senator Nixon who sent up a committee
amendment to explain his amendment. The Chair recognized
Senator Nixon who withdrew his amendment.
Senator Moncrief sent up Committee Amendment 6 and moved
adoption; without objection, the amendment was adopted.
The Chair recognized Senator Nixon who sent up a committee
amendment to explain his amendment. The Chair recognized
Senator Nixon who withdrew his amendment.
Senator Moncrief sent up Committee Amendment 7 and moved
adoption; without objection, the amendment was adopted.
Senator Moncrief sent up Committee Amendment 8 and moved
adoption; without objection, the amendment was adopted.
Senator Nixon sent up Committee Amendment 9 and moved
adoption; without objection, the amendment was adopted.
The Chair recognized Senator Nixon who sent up a committee
amendment to explain his amendment. The Chair recognized
Senator Nixon who withdrew his amendment.
Senator Moncrief sent up Committee Amendment 10 and moved
adoption; without objection, the amendment was adopted.
Senator Nixon requested unanimous consent to incorporate
amendments into the committee substitute; without objection,
it was so ordered. Senator Moncrief then moved that the new
committee substitute be adopted; without objection, it was so
ordered.
Senator Nixon moved that SB 93 do not pass, but that CSSB 93
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 3
ayes, 0 nays, 0 present not voting, and 0 absent.
There being no further business, at 9:45 a.m., Senator Lindsay
moved that the Committee be adjourned. Without objection, it
was so ordered.
