Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Criminal
Justice was held on Wednesday, March 24, 1999 in the Capitol
Extension, Room E1.016, at Austin, Texas.

The Chair called the meeting to order at 2:10 pm. There being
a quorum present, the following business was transacted.
The following members arrived after the roll was called:
none.
The Chair laid out SB 1157 and recognized the author, Senator
Carona, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. Public testimony was closed.
Senator West moved that SB 1157 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 7 ayes, 0 nays, 0 present
not voting, and 0 absent.
Senator Duncan requested unanimous consent to be shown voting
aye on SB 1157. There being no objection, the motion
prevailed.
Senator West moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
The Chair laid out SB 557 and recognized the author, Senator
Lucio, Jr., to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. Public testimony was closed.
Senator Shapiro moved that SB 557 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 4 ayes, 2 nays, 0 present
not voting, and 1 absent.
The Chair laid out SB 559 and recognized the author, Senator
Lucio, Jr., to explain the bill.
Senator West sent up a committee substitute for SB 559 and
moved adoption, without objection, it was adopted.

The Chair moved that SB 559 be left pending; without
objection, it was so ordered.
The Chair laid out SB 280 and recognized the author, Senator
Bivins, to explain the bill.
Senator West sent up a committee substitute for SB 280 and
explained the difference between the bill and the substitute.
At 3:45 pm Senator Whitmire assumed the chair.

At 3:50 pm Senator Armbrister resumed the chair.
Senator West moved that SB 280 be left pending; without
objection, it was so ordered.
At 5:25 pm Senator West assumed the chair.
The Chair laid out SB 894 and recognized Senator Armbrister,
in the absence of the author, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Nelson moved that SB 894 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 7 ayes, 0 nays, 0 present
not voting, and 0 absent.
Senators Jackson and Whitmire requested unanimous consent to
be shown voting aye on SB 894; without objection, it was so
ordered.
Senator Nelson moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.

Armbrister, to explain the bill.
Senator Armbrister sent up a committee substitute for SB 739
and explained the difference between the bill and the
substitute.

Senator Armbrister moved that SB 739 be left pending; without
objection, it was so ordered.
Senator Armbrister resumed the chair at 6:35 pm.
The Chair laid out SB 32 and recognized the author, Senator
Shapiro, to explain the bill.
Senator Shapiro sent up a committee substitute for SB 32 and
explained the difference between the bill and the substitute.
Senator Shapiro sent up Committee Amendment 1 and moved
adoption, without objection, it was adopted. Senator Shapiro
then moved that Amendment 1 be rolled into the body of the
substitute, without objection, it was so ordered.
Senator Shapiro moved adoption of CSSB 32 and without
objection, it was so ordered.
Senator Shapiro moved that SB 32 do not pass but that CSSB 32
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 6
ayes, 0 nays, 0 present not voting, and 1 absent.
Senators Jackson and Whitmire requested unanimous consent to
be shown voting aye on CSSB 32, without objection, it was so
ordered.
Senator Shapiro moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
The Chair laid out SB 421 and recognized the author, Senator
Shapiro, to explain the bill.
Senator Shapiro sent up a committee substitute for SB 421
moved adoption, without objection, it was so ordered.

Senator Shapiro moved that SB 421 do not pass but that CSSB
421 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.
Senators Jackson and Whitmire requested unanimous consent to
be shown voting aye on CSSB 421 and without objection, it was
so ordered.
Senator Shapiro moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
At 6:40 pm Senator Duncan assumed the chair.
The Chair laid out SB 403 and recognized the author, Senator
Armbrister, to explain the bill.
Senator Armbrister sent up a committee substitute; the Chair
recognized Senator Armbrister to explain the difference
between the committee substitute and the bill as filed.
Senator Armbrister sent up Committee Amendment 1 and moved
adoption, without objection, it was so ordered. Senator
Armbrister requested that the committee amendment be rolled
into the body of CSSB 403, without objection, it was so
ordered.
Senator Armbrister moved that SB 403 be left pending; without
objection, it was so ordered.
Senator Armbrister resumed the Chair at 7:50 pm.
Senator Duncan moved adoption of the minutes from the meetings
of March 10, 1999, and March 17, 1999; without objection, the
minutes were adopted.
There being no further business, at 7:55 pm Senator Armbrister
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
