MINUTES SENATE COMMITTEE ON REDISTRICTING Friday, September 22, 2000 10:30 a.m. Senate Chamber ***** Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Redistricting was held on Friday, September 22, 2000, in the Senate Chamber at Austin, Texas. ***** MEMBERS PRESENT: MEMBERS ABSENT: Senator Troy Fraser None Senator Mario Gallegos, Jr. Senator Gonzalo Barrientos Senator Robert Duncan Senator Mike Jackson Senator Eddie Lucio, Jr. Senator Frank Madla Senator Jane Nelson Senator Steve Ogden Senator Florence Shapiro Senator Royce West ***** Co-chair Fraser called the meeting to order at 10:55 a.m. There being a quorum present, the following business was transacted: Co-chair Fraser moved adoption of the minutes from the previous hearing held on August 25, 2000; without objection, it was so ordered. Co-chair Fraser and Senator Barrientos welcomed everyone to the Austin regional hearing. Chairman Jones announced that they were working on putting together a meeting to allow the Congressional delegation to address the committees. Senator Barrientos made a parliamentary inquiry as to whether he would be in order to make a motion recommending that the President and Congress designate the adjusted census figures, based on statistical sampling, be the official census figures under Public Law 94-171. Co-chair Fraser advised Senator Barrientos that his motion would be in order. Then Senator Barrientos made a motion recommending that the President and Congress designate the adjusted census figures, based on statistical sampling, be the official census figures under Public Law 94-171. Co-Chair Gallegos seconded the motion. Senator Duncan laid out a substitute motion to Senator Barrientos's motion. He moved to postpone addressing whether adjusted (sampled) or unadjusted (enumerated) figures should be used for the purpose of redistricting until the official figures are released in spring of 2001. Senator Duncan's substitute motion was seconded by Senator Ogden. Co-Chair Gallegos raised a parliamentary inquiry asking whether Senator Duncan's substitute motion was on the same subject as Senator Barrientos's original motion. Co-Chair Fraser ruled that Senator Duncan's substitute motion was germane to the original motion. Senator Duncan's substitute motion passed with a vote of 6 "ayes" and 5 "nays". Senator Barrientos's motion as substituted passed with a vote of 6 "ayes" and 5 "nays". Senator Barrientos asked to be recognized for a second motion. Co-chair Fraser agreed to recognize Senator Barrientos at the conclusion of public testimony. At which time, Senator Barrientos withdrew his request to be recognized.
