Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Education
was held on Wednesday, March 3, 1999 in the Capitol Extension,
Room E1.012, at Austin, Texas.

The Chair called the meeting to order at 12:15 pm. There
being a quorum present, the following business was transacted.
The Chair laid out SB 42 and recognized the author, Senator
Shapiro, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Cain sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted. Senator Sibley
sent up an amendment to Committee Amendment 1 and moved
adoption; without objection the amendment to Committee
Amendment 1 was adopted. Senator Zaffirini moved that the
amended amendment be rolled into the bill to create a
committee substitute and moved adoption of the new substitute;
without objection, it was so ordered. Senator Zaffirini moved
that SB 42 do not pass but that CSSB 42 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 9 ayes, 0 nays, 0
present not voting, and 0 absent.
Senator Luna moved that the committee minutes from the prior
committee hearing be approved, without objection, the minutes
were approved.
The Chair laid out SB 104 and recognized the author, Senator
Duncan, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Zaffirini sent up a committee substitute; the Chair
recognized Senator Duncan to explain the difference between
the committee substitute and the bill as filed. Senator
Zaffirini moved adoption of the committee substitute, without
objection, it was so ordered. Senator Luna moved that SB 104
do not pass but that CSSB 104 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 9 ayes, 0 nays, 0 present not
voting, and 0 absent. Senator West moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The Chair announced that no action would be taken on SB 235 by
Ellis and SB 470 by Harris at the request of the authors.
The Chair laid out SB 476 and recognized the author, Senator
Luna, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Cain moved that SB 476 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 8 ayes, 0 nays, 0 present
not voting, and 1 absent. Senator Luna moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The subcommittee report on SB 315 was laid out by the Chair.
The Chair and recognized the author, Senator Ellis, to explain
the bill. Senator West moved adoption of the subcommittee
report on SB 315; without objection, it was adopted. Senator
West moved that SB 315 be reported favorably to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 8 ayes, 0 nays, 0 present not
voting, and 1 absent. Senator Sibley moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The subcommittee report on SB 192 was laid out by the Chair.
The Chair and recognized the author, Senator Ogden, to explain
the bill. Senator West moved adoption of the subcommittee
report on SB 192 as amended; without objection, it was
adopted. Senator Zaffirini moved that the amendment be rolled
in to the bill to create a new committee substitute; without
objection it wa so ordered. Senator Zaffirini moved that the
new substitute be adopted; without objection, it was adopted.
Senator West moved that SB 192 do not pass but that CSSB 192
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 7
ayes, 0 nays, 1 present not voting, and 1 absent.
At 1:20 pm Senator Luna assumed the chair.
The Chair laid out SB 116 and recognized the author, Senator
Bivins, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Bivins moved that SB 116 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 7 ayes, 1 nay, 0 present not
voting, and 1 absent.
The Chair laid out SB 225 and recognized the author, Senator
Bivins, to explain the bill. Witnesses testifying and

The Chair laid out SB 669 and recognized the author, Senator
Ratliff, to explain the bill. Senator Ratliff sent up a
committee substitute; the Chair recognized Senator Ratliff to
explain the difference between the committee substitute and
the bill as filed. Senator Ratliff moved adoption of the
committee substitute, without objection, it was so ordered.
Senator Ratliff sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Senator Bivins moved that the amendment be rolled in to the
bill to create a committee substitute; without objection, it
was so ordered. Senator Bivins moved adoption of the new
committee substitute; there being no objection, it was
adopted. Witnesses testifying and registering on the bill are
shown on the attached list. Senator Ratliff moved that SB 669
do not pass but that CSSB 669 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 9 ayes, 0 nays, 0 present not
voting, and 0 absent.
There being no further business, at 2:15 pm Senator Bivins
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
