Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Education
was held on Wednesday, February 24, 1999 in the Capitol
Extension, Room E1.012, at Austin, Texas.

The Chair called the meeting to order at 12:40 pm. There
being a quorum present, the following business was transacted.
The following members arrived after the roll was called:
Senator Cain, Senator Ogden, Senator West.
Senator Zaffirini moved to approve the committee minutes for
the Education Committee hearing dated February 17, 1999.
There being no objection, the minutes were unanimously
approved.
The Chair laid out SB 111 and recognized the author, Senator
Carona, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Zaffirini moved that SB 111 be reported favorably to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 7 ayes, 0 nays, 0
present not voting, and 2 absent.
Senator Nelson moved that the bill be recommended for
placement on the Local & Uncontested Calendar; Senator West
objected to the motion, therefore the bill was not recommended
for placement on the Local & Uncontested Calendar.
The Chair announced that no action would be taken on SB 225 by
Bivins.
At 12:50 pm Senator Luna assumed the chair.
The Chair laid out SB 103 and recognized the author, Senator
Bivins, to explain the bill. Senator Bivins sent up a
committee substitute; the Chair recognized Senator Bivins to
explain the difference between the committee substitute and
the bill as filed. Senator Bivins moved adoption of the
committee substitute, without objection, it was so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list. Senator Bivins moved that SB 103 be left
pending; without objection, it was so ordered.
At 2:55 pm Senator Bivins resumed the chair.
The Chair laid out SB 237 and recognized Senator Cain, in the
absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the
attached list. Senator Cain sent up Committee Amendment 1 and
moved adoption; without objection, the amendment was adopted.
Senator Cain moved that Committee Amendment 1 be rolled into
the bill to create CSSB 237, there being no objection, it was
so ordered. Senator Cain moved that SB 237 do not pass but
that CSSB 237 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 7 ayes, 0 nays, 0 present not voting,
and 2 absent.
There being no further business, at 3:20 pm Senator Bivins
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
