MINUTES SENATE COMMITTEE ON ECONOMIC DEVELOPMENT Tuesday, February 16, 1999 9:00 am Lt. Governor's Committee Room ***** Pursuant to a notice posted in accordance with Senate Rule 11.11, a public hearing of the Senate Committee on Economic Development was held on Tuesday, February 16, 1999 in the Lt. Governor's Committee Room, at Austin, Texas. ***** MEMBERS PRESENT: MEMBERS ABSENT: Senator David Sibley, Chairman Senator Troy Fraser Senator Kenneth Armbrister, Vice Chairman Senator John Carona Senator Mike Jackson Senator Frank Madla Senator John Whitmire ***** The Chairman called the meeting to order at 9:00 am. There being a quorum present, the following business was transacted. Chairman Sibley laid out SB 91, SB 92 and SB 105 and recognized the author, Senator Harris, to explain the bills. Rob Carter, representing the Texas Department of Insurance, testified as a resource witness on the bills. Tom Rutledge, representing Texas Land Title Association, registered in favor of the bills but did not testify. Senator Carona moved that SB 91 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Whitmire moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. Senator Jackson moved that SB 92 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Whitmire moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. Senator Madla moved that SB 105 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Whitmire moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. The Chair laid out SB 85 and recognized the author, Senator Carona, to explain the bill. David East, representing Texas Business Law Foundation, testified in favor of the bill. Karen Neeley, representing Independent Bankers Association of Texas, registered in favor of the bill but did not testify. Senator Carona moved that SB 85 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. At 9:15 am Senator Armbrister assumed the chair, laid out SB 333 and recognized the author, Senator Sibley, to explain the bill. Senator Sibley sent up a committee substitute and explained the difference between the committee substitute and the bill as filed. Senator Sibley moved adoption of the committee substitute, without objection, it was so ordered. Greg Huffman, representing Charitable Accord, testified in favor of the bill. The Chairman read the names of the following witnesses who registered in favor of the bill but did not wish to testify: George Bristol, representing Charitable Accord Richard Daly, representing Texas Catholic Conference Norman Hood, representing Independent Colleges and Universities of Texas Marion Sanford, representing Texas Business Law Foundation Karen Wood, representing Baylor University Senator Sibley moved that SB 333 do not pass but that CSSB 333 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Sibley moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. At 9:22 am Senator Sibley resumed the chair and there being no further business, Chairman Sibley moved that the Committee stand recessed subject to the call of the Chairman.
