HBA-EVB S.B. 1676 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1676 By: Bernsen Licensing & Administrative Procedures 5/19/1999 Engrossed BACKGROUND AND PURPOSE Currently, the Texas Alcoholic Beverage Code prohibits the manufacture, import, sale, or possession for the purposes of sale of any alcoholic beverage made from dried grapes, dried fruits, or dried berries. S.B. 1676 deletes text from the Alcoholic Beverage Code, to allow for the production of alcoholic beverages made from dried grapes, dried fruits, or dried berries. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 101.65, Alcoholic Beverage Code, to remove an alcoholic beverage made from dried grapes, dried fruits, or dried berries from a list of alcoholic beverages that a person is prohibited from manufacturing, importing, selling, or possessing for the purpose of sale. Redesignates existing Subdivisions (2) through (5) as Subdivisions (1) through (4) to make a conforming change. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
