Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Senate
Select Committee on Tax Reform & Public School Finance was
held on Tuesday, May 6, 1997 in the Senate Chamber at Austin,
Texas.

Senator Armbrister called the meeting to order at 9:05 am.
The following business was transacted.
The following members arrived after the roll was called:
none.
The Committee began reviewing and taking action on Committee
Amendments on HB 4 with record votes being taken on the
following:
Senator Bivins moved to adopt Committee Amendment 1, which was
sent up on Monday, May 5, 1997. The motion failed by a vote of
4 ayes, 7 nays, 0 present not voting, and 0 absent.
Senator Bivins moved to adopt Committee Amendment 2, which was
sent up on Monday, May 5, 1997. The motion carried with a vote
of 10 ayes, 1 nay, 0 present not voting, and 0 absent.
Senator Barrientos sent up Committee Amendment 4 and after
explanation moved adoption of same.
The motion failed by a vote of 1 aye, 10 nays, 0 present not
voting, and 0 absent.
Senator Barrientos sent up Committee Amendment 5 and after
explanation moved adoption of same.
The motion failed by a vote of 2 ayes, 9 nays, 0 present not
voting, and 0 absent.
The Committee recessed at 9:45 am for Senate Session and
resumed at 2:15 pm.
Senator Barrientos sent up Committee Amendment 10 and Senator
Bivins sent up an amendment to Committee Amendment 10.
Senator Barrientos moved to adopt amendment, as amended.
The motion carried with a vote of 6 ayes, 5 nays, 0 present
not voting, and 0 absent.
Senator Bivins sent up Committee Amendment 17 and a Committee
Substitute to CA 17 and after explanation moved to adopt
amendment, as substituted. The motion carried with a vote of 8
ayes, 2 nays, 0 present not voting, and 1 absent.
Senator Bivins sent up Committee Amendment 24 and an amendment
to CA 24 and moved adoption of Committee Amendment 24, as
amended. The motion failed by a vote of 5 ayes, 5 nays, 0
present not voting, and 1 absent.
Senator Carona sent up Committee Amendment 25 and after
explanation moved adoption of CA 25. The motion carried with
a vote of 6 ayes, 3 nays, 0 present not voting, and 2 absent.
Senator Shapiro sent up substitute amendment to Committee
Amendment 31. Senator Bivins sent up a substitute amendment
to Senator Shapiro's substitute.
Senator Bivins moved to adopt the substitute amendment to
Shapiro's Committee Amendment Substitute to Committee
Amendment 31. The motion carried with a vote of 5 ayes, 4
nays, 0 present not voting, and 2 absent.
The Committee recessed from 4:18 pm and resumed at 4:26 pm.
Senator Shapiro moved to adopt Committee Amendment 31, as
substituted. The motion carried with a vote of 7 ayes, 3
nays, 0 present not voting, and 1 absent.
Senator Shapiro moved to adopt Committee Amendment 30. The
motion carried with a vote of 5 ayes, 4 nays, 0 present not
voting, and 2 absent.
Senator Nixon moved to reconsider the Committee's action on CA
30. There were no objections and the motion was adopted.
Senator Shapiro withdrew CA 30.
Senator Shapiro moved to adopt Committee Amendment 33. The
motion carried with a vote of 7 ayes, 3 nays, 0 present not
voting, and 1 absent.
Senator Barrientos moved to reconsider action on Committee
Amendment 1. There were no objections and the motion was
adopted.
Senator Bivins resubmitted Committee Amendment 1. Senator
Bivins then withdrew Committee Amendment 1.
Senator Luna sent up Committee Amendment 36 and moved adoption
of same. The motion failed by a vote of 3 ayes, 7 nays, 0
present not voting, and 1 absent.
Senator Luna sent up Committee Amendment 39 and moved
adoption of same. The motion failed by a vote of 3 ayes, 7
nays, 0 present not voting, and 1 absent.
Senator Luna sent up Committee Amendment 40 and moved adoption
of same. The motion failed by a vote of 3 ayes, 7 nays, 0
present not voting, and 1 absent.
Senator Luna sent up Committee Amendment 41 and moved
adoption. The motion failed by a vote of 3 ayes, 6 nays, 0
present not voting, and 2 absent.
The Committee considered Committee Amendment 44. Senator
Ellis moved to adopt Committee Amendment 44, as amended. The
motion carried with a vote of 9 ayes, 1 nay, 0 present not
voting, and 1 absent.
Senator Fraser moved to adopt Committee Amendment 48. The
motion failed by a vote of 1 aye, 7 nays, 2 present not
voting, and 1 absent.
Senator Bivins moved to adopt Committee Amendment 1. The
motion carried with a vote of 7 ayes, 3 nays, 1 present not
voting, and 0 absent.
Senator Barrientos sent up Substitute Amendment for Committee
Amendment 6. Senator Ellis sent up an Amendment to the new
Substitute Amendment.
Senator Ellis moved to adopt the amendment to the Substitute
Amendment to CA 6. The motion failed by a vote of 2 ayes, 9
nays, 0 present not voting, and 0 absent.
Senator Barrientos moved to adopt Substitute Amendment 6. The
motion failed by a vote of 3 ayes, 8 nays, 0 present not
voting, and 0 absent.
The Committee recessed at 6:50 pm and resumed at 7:40 pm.
Senator Carona sent up a Substitute Amendment for Committee
Amendment 28 and moved adoption. The motion failed by a vote
of 3 ayes, 6 nays, 0 present not voting, and 2 absent.
Senator Nixon sent up Committee Amendment 60 and moved
adoption. The motion carried with a vote of 6 ayes, 5 nays, 0
present not voting, and 0 absent.
The Committee began considering amendments to HJR 4 with
record votes being taken on the following.
Senator Luna sent up Committee Amendment 2 and moved adoption.
The motion carried with a vote of 11 ayes, 0 nays, 0 present
not voting, and 0 absent.
Senator Shapiro sent up Committee Amendment 3 and moved
adoption. The motion carried with a vote of 8 ayes, 2 nays, 1
present not voting, and 0 absent.
Senator Carona sent up Committee Amendment 5 and moved
adoption. The motion failed by a vote of 2 ayes, 8 nays, 0
present not voting, and 1 absent.
The Committee continued to take public testimony on HB 4 and
HJR 4. Attached to these minutes are the witnesses that
testified or registered.
Senator Bivins moved to roll the adopted Committee Amendments
into a complete Committee Substitute for HB 4. There were no
objections and the motion was adopted.
Senator Bivins moved to roll the adopted Committee Amendments
into a complete Committee Substitute for HJR 4. There were no
objections and the motion was adopted.
There being no further business, at 8:50 pm Senator Armbrister
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
