Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Education
was held on Wednesday, April 30, 1997 in the Capitol
Extension, Room E1.012, at Austin, Texas.

The Chair called the meeting to order at 9:10 am. The
following business was transacted.
At 9:11 am Senator Luna assumed the chair.
The Chair laid out HB 2721 and recognized the Senate sponsor,
Senator Bivins, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
Chair moved that HB 2721 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Fraser moved HB 2721 be reported back to the
senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 10 ayes, 0 nays, 0 present
not voting, and 1 absent. Senator Bivins moved that the bill
be recommended for placement on the Local & Uncontested
Calendar, without objection, it was so ordered.
At 9:15 am Senator Bivins resumed the chair.
The Chair laid out SB 1522 and recognized the author, Senator
Lucio, Jr., to explain the bill. Senator Luna sent up a
committee substitute; the Chair recognized Senator Lucio, Jr.
to explain the difference between the committee substitute and
the bill as filed. Senator Luna moved adoption of the
committee substitute, without objection, it was so ordered.
The Chair moved that SB 1522 be left pending; without
objection, it was so ordered.
The Chair laid out SCR 75 and recognized the author, Senator
West, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator West sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted. Senator West
moved that SCR 75, as amended, be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 8 ayes, 0 nays, 0 present not
voting, and 3 absent. Senator West moved that the bill be
recommended for placement on the Local & Uncontested Calendar,
without objection, it was so ordered.
The Chair laid out HB 588 and recognized the Senate sponsor,
Senator Barrientos, to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached list.
The Chair moved that HB 588 be left pending until the
committee reconvened after the daily Senate session adjourned;
without objection, it was so ordered.
At 9:55 am the committee recessed until 30 minutes after
adjournment of the daily Senate session.
At 2:50 pm the committee reconvened.
At 2:50 pm Senator Luna assumed the chair.
At this time, the committee continued to hear testimony on HB
588. The Chair moved that HB 588 be left pending to await a
quorum; without objection it was so ordered.
At 2:55 pm Senator Haywood assumed the chair.
The Chair laid out SB 1918 and recognized the author, Senator
Luna, to explain the bill. Senator Luna sent up a committee
substitute; the Chair recognized Senator Luna to explain the
difference between the committee substitute and the bill as
filed. Senator Luna moved adoption of the committee
substitute, without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the
attached list. Senator Luna sent up Committee Amendment 1 and
moved adoption; without objection, the amendment was adopted.
Senator Luna sent up Committee Amendment 2 and moved adoption;
without objection, the amendment was adopted. Senator Luna
sent up Committee Amendment 3 and moved adoption; without
objection, the amendment was adopted. Senator Luna sent up
Committee Amendment 4 and moved adoption; without objection,
the amendment was adopted. The Chair moved that SB 1918 be
left pending; without objection it was so ordered.
The Chair laid out SB 1919 and recognized the author, Senator
Luna, to explain the bill. Senator Luna sent up a committee
substitute; the Chair recognized Senator Luna to explain the
difference between the committee substitute and the bill as
filed. Senator Luna moved adoption of the committee
substitute, without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the
attached list. Senator Luna sent up Committee Amendment 1 and
moved adoption; without objection, the amendment was adopted.

without objection, the amendment was adopted. The Chair moved

ordered.
At 3:20 pm Senator Luna resumed the chair.
The Chair laid out SB 100 and recognized the author, Senator
Patterson, to explain the bill. Senator Shapleigh sent up a
committee substitute; the Chair recognized Senator Patterson
to explain the difference between the committee substitute and
the bill as filed. Senator Shapleigh moved adoption of the
committee substitute, without objection, it was so ordered.

the attached list. The Chair moved that SB 100 be left
pending; without objection, it was so ordered.
At 4:45 pm the committee recessed to await a quorum.
At 4:55 pm the committee reconvened.
The Chair laid out SB 1653 and recognized Senator Shapleigh,
in the absence of the author, to explain the bill. Senator
Shapleigh sent up a committee substitute; the Chair recognized
Senator Shapleigh to explain the difference between the
committee substitute and the bill as filed. Senator Shapleigh
moved adoption of the committee substitute, without objection,
it was so ordered. Witnesses testifying and registering on
the bill are shown on the attached list. The Chair moved that
SB 1653 be left pending; without objection, it was so ordered.
At 5:30 pm the committee recessed subject to the call of the
Chair.
At 11:55 am on 05/01/97 the committee reconvened Senator
Bivins' desk on the Senate floor.
At 11:55 am Senator Bivins resumed the chair.
The Chair laid out HB 2528 and, in the absence of the Senate
sponsor, explained that HB 2528 is the House companion to SB
1522 by Lucio, and that the committee would be voting on the
House Bill in lieu of the Senate Bill. Senator Barrientos
moved that HB 2528 be reported favorably to the full Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 8 ayes, 0 nays, 0 present not
voting, and 3 absent. Senator Barrientos moved that the bill
be recommended for placement on the Local & Uncontested
Calendar, without objection, it was so ordered.
The Chair recognized Senator Barrientos for a motion on HB
588. Senator Barrientos moved that HB 588 be reported
favorably to the full Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 8
ayes, 0 nays, 0 present not voting, and 3 absent.
The Chair laid out SB 1221 and recognized the author, Senator
Luna, to explain the bill. Senator Luna sent up a committee
substitute; the Chair recognized Senator Luna to explain the
difference between the committee substitute and the bill as
filed. Senator Luna moved adoption of the committee
substitute, without objection, it was so ordered. Senator
Luna moved that SB 1221 do not pass but that CSSB 1221 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a vote of 8
ayes, 0 nays, 0 present not voting, and 3 absent. Senator
Luna moved that the bill be recommended for placement on the
Local & Uncontested Calendar, without objection, it was so
ordered.
There being no further business, at 12:01 pm the Chair moved
that the Committee stand recessed subject to the call of the
Chair. Without objection, it was so ordered.
