  S.B. No. 365
 
 
 
 
AN ACT
  relating to the issuance or amendment of a certificate of public
  convenience and necessity that authorizes the construction of an
  electrical substation.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 37.054, Utilities Code, is amended by
  adding Subsection (c) to read as follows:
         (c)  In addition to any notice provided under Subsection (a),
  the commission shall require the applicant to provide written
  notice of each substation proposed to be authorized by a
  certificate of convenience and necessity to each owner of:
               (1)  property adjacent to the property on which the
  substation will be located; and
               (2)  property located directly across a highway, road,
  or street that is adjacent to the property on which the substation
  will be located.
         SECTION 2.  The changes in law made by this Act apply only to
  a proceeding affecting a certificate of public convenience and
  necessity that commences on or after the effective date of this Act.
  A proceeding affecting a certificate of public convenience and
  necessity that commenced before the effective date of this Act is
  governed by the law in effect on the date the proceeding is
  commenced, and that law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2023.
