AN ACT
|
|
|
relating to a common characteristic or use project in a public |
|
|
improvement district in certain municipalities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 372.0035(a), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(a) This section applies only to: |
|
|
(1) a municipality that: |
|
|
(A) has a population of more than 650,000 and |
|
|
less than two million; [or] |
|
|
(B) has a population of more than 325,000 and |
|
|
less than 625,000; or |
|
|
(C) has a population of more than 180,000 and |
|
|
less than 200,000; and |
|
|
(2) a public improvement district established under |
|
|
this subchapter and solely composed of territory in which the only |
|
|
businesses are: |
|
|
(A) hotels with 100 or more rooms ordinarily used |
|
|
for sleeping, if the district is established by a municipality |
|
|
described by Subdivision (1)(A); [or] |
|
|
(B) hotels with 75 or more rooms ordinarily used |
|
|
for sleeping, if the district is established by a municipality |
|
|
described by Subdivision (1)(B); or |
|
|
(C) hotels with 10 or more rooms ordinarily used |
|
|
for sleeping, if the district is established by a municipality |
|
|
described by Subdivision (1)(C). |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
