BACKGROUND AND PURPOSE

 

It has been suggested that it may be beneficial for a county to be able to offer, require the use of, and charge a fee for solid waste disposal services in the extraterritorial jurisdiction of a municipality. H.B. 3045 seeks to authorize certain counties to do so.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3045 amends the Health and Safety Code to authorize a county to offer, require the use of, and charge a fee for solid waste disposal services in the extraterritorial jurisdiction of a municipality wholly or partly located in a county with a population of more than 54,000 and less than 54,500. The bill prohibits such a municipality from providing solid waste disposal services or charging a fee for those services in the municipality's extraterritorial jurisdiction if the county provides those services under the bill's provisions.

September 1, 2019.
