A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment denying bail to certain |
|
|
persons who are unlawfully present in the United States and are |
|
|
taken into custody for committing a felony. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article I, Texas Constitution, is amended by |
|
|
adding Section 11d to read as follows: |
|
|
Sec. 11d. A person taken into custody for committing a |
|
|
felony shall be denied release on bail pending trial if a judge or |
|
|
magistrate, following a hearing, determines that the person is not |
|
|
a citizen or national of the United States and is not lawfully |
|
|
present in the United States. |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 7, 2017. |
|
|
The ballot shall be printed to provide for voting for or against the |
|
|
proposition: "The constitutional amendment denying bail to certain |
|
|
persons who are unlawfully present in the United States and are |
|
|
taken into custody for committing a felony." |
