A BILL TO BE ENTITLED
 
AN ACT
  relating to a requirement that each public institution of higher
  education develop and implement a strategic plan for the prevention
  of sexual assault and unplanned pregnancy.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 51, Education Code, is
  amended by adding Section 51.9364 to read as follows:
         Sec. 51.9364.  STRATEGIC PLAN FOR PREVENTION OF SEXUAL
  ASSAULT AND UNPLANNED PREGNANCY.  (a)  In this section,
  "institution of higher education" has the meaning assigned by
  Section 61.003.
         (b)  Each institution of higher education shall develop and
  implement a strategic plan for the prevention of sexual assault on
  the institution's campus and unplanned pregnancy among the students
  enrolled at the institution.
         (c)  The strategic plan must:
               (1)  identify opportunities for raising awareness
  among, and providing information and resources to, students
  regarding campus sexual assault and unplanned pregnancy
  prevention, including through:
                     (A)  the use of special events, presentations, and
  training sessions for students and student organizations; and
                     (B)  the integration of educational information
  into student orientation programs provided to new students and
  counseling or advising services provided to continuing students;
  and
               (2)  be approved by the institution's governing board
  before final adoption by the institution.
         (d)  Each biennium, each institution of higher education
  shall review the institution's strategic plan and, with approval of
  the institution's governing board, revise the plan as necessary.
         (e)  In consultation with institutions of higher education,
  the Texas Higher Education Coordinating Board shall adopt any rules
  the coordinating board considers appropriate for the
  administration of this section.
         SECTION 2.  Not later than January 1, 2018, the Texas Higher
  Education Coordinating Board shall adopt the rules required by
  Section 51.9364, Education Code, as added by this Act.
         SECTION 3.  Not later than September 1, 2018, each public
  institution of higher education shall develop and implement the
  strategic plan required by Section 51.9364, Education Code, as
  added by this Act.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
