A BILL TO BE ENTITLED
 
AN ACT
  relating to continuing education requirements for a laser hair
  removal certificate or license.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter M, Chapter 401, Health and Safety
  Code, is amended by adding Section 401.5095 to read as follows:
         Sec. 401.5095.  CONTINUING EDUCATION. (a) The commission
  by rule shall:
               (1)  establish a minimum number of hours of continuing
  education required for certificate or license renewal under this
  subchapter; and
               (2)  recognize, prepare, or administer a continuing
  education program for a person certified or licensed under this
  subchapter.
         (b)  The department may develop and adopt:
               (1)  a process to evaluate or approve a continuing
  education provider or program; and
               (2)  a process to assess a certificate holder's or
  license holder's participation in a continuing education program.
         SECTION 2.  Not later than August 31, 2017, or as soon as
  practicable after the effective date of this Act if more time is
  required, the Texas Commission of Licensing and Regulation shall
  ensure rules are adopted as required by Section 401.5095, Health
  and Safety Code, as added by this Act.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
