A BILL TO BE ENTITLED
 
AN ACT
 
  relating to restoration of the position of public employees when
  relieved of duty from the Texas military forces or a similar unit.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 437.202(d), Government Code, is amended
  to read as follows:
         (d)  An employee of this state or a municipality, a county,
  or another political subdivision of this state with at least five
  full-time employees [A state employee] who is a member of the Texas
  military forces, a reserve component of the armed forces, or a
  member of a state or federally authorized urban search and rescue
  team and who is ordered to duty by proper authority is entitled,
  when relieved from duty, to be restored to the position that the
  employee held when ordered to duty.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
