A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a reduction of the amount required to be paid by certain |
|
school districts to achieve the equalized wealth level under the |
|
public school finance system. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 41, Education Code, is |
|
amended by adding Section 41.0933 to read as follows: |
|
Sec. 41.0933. REDUCTION FOR LOSS OF FORMER FUNDING. (a) |
|
This section applies only to a school district that for the current |
|
school year would have been entitled to receive additional state |
|
aid for tax reduction under Section 42.2516, as that section |
|
existed January 1, 2017. |
|
(b) Notwithstanding any other provision of this chapter, a |
|
school district that executes an agreement to purchase all |
|
attendance credits necessary to reduce the district's wealth per |
|
student to the equalized wealth level may reduce the total amount |
|
required to be paid for attendance credits under Section 41.093 for |
|
a school year by the amount of additional state aid for tax |
|
reduction that the district would have been entitled to receive for |
|
that school year under Section 42.2516, as that section existed |
|
January 1, 2017. |
|
(c) A reduction under Subsection (b) is in addition to any |
|
other reduction to which the district is entitled under this code. |
|
(d) In implementing this section, the commissioner shall |
|
make determinations regarding additional state aid for tax |
|
reduction under Section 42.2516, as that section existed January 1, |
|
2017, using the percentage reduction for purposes of former Section |
|
42.2516(i) specified by appropriation for the 2016-2017 school |
|
year. |
|
(e) This section expires September 1, 2019. |
|
SECTION 2. This Act takes effect September 1, 2017, if it |
|
receives a vote of two-thirds of all the members elected to each |
|
house, as provided by Section 39, Article III, Texas Constitution. |
|
If this Act does not receive the vote necessary for effect on that |
|
date, this Act takes effect on the 91st day after the last day of the |
|
legislative session. |
