A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to authority of certain general-law municipalities to |
|
|
annex an area on petition by owners. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Section 43.032, Local Government |
|
|
Code, is amended to read as follows: |
|
|
Sec. 43.032. AUTHORITY OF CERTAIN [TYPE A] GENERAL-LAW |
|
|
MUNICIPALITIES TO ANNEX AN AREA ON [UPON] PETITION BY OWNERS. |
|
|
SECTION 2. Section 43.032(a), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(a) The governing body of a general-law municipality with a |
|
|
population of 1,500 to 5,000 [1,599] may annex an area: |
|
|
(1) that is adjacent to the annexing municipality; |
|
|
(2) that is not being served with water or sewer |
|
|
service from a governmental entity; and |
|
|
(3) for which a petition requesting annexation has |
|
|
been filed with the municipality. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
